{"id":10004,"date":"2021-07-13T11:27:34","date_gmt":"2021-07-13T11:27:34","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=10004"},"modified":"2021-07-13T11:28:00","modified_gmt":"2021-07-13T11:28:00","slug":"jk-hc-strikes-line-of-difference-between-sexual-assault-and-attempt-to-rape","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/jk-hc-strikes-line-of-difference-between-sexual-assault-and-attempt-to-rape\/","title":{"rendered":"J&#038;K HC strikes line of difference between sexual assault and attempt to rape"},"content":{"rendered":"\n<p>The Jammu &amp; Kashmir High Court, while allowing a bail application, held that the act of accused taking off his own and victim\u2019s trousers, in the absence of penetration, does not amount to attempt to rape, rather may fall under the meaning of sexual assault under POCSO Act.<\/p>\n\n\n\n<p>In the instant case, according to the complainant, the petitioner-accused made an attempt to rape her niece when she went to latter\u2019s house for purchasing mobile accessories. The medical examination revealed that neither sexual intercourse took place nor any mark of violence.<\/p>\n\n\n\n<p>The victim in her statement, <a href=\"https:\/\/lexforti.com\/legal-news\/statements-recorded-under-section-313-crpc-not-a-mere-procedural-formality-sc\/\" target=\"_blank\" rel=\"noreferrer noopener\">recorded under Section 164 CrPC<\/a>, stated that petitioner-accused removed his own as well as her trousers, however, upon hearing about his brother\u2019s arrival, he went to the other side.<\/p>\n\n\n\n<p>The court observed that the act of petitioner-accused had been directed towards the effort of making preparation for committing an attempt. It was further observed that without there being any further act on petitioner\u2019s part, it was difficult to conclude whether he had <a href=\"https:\/\/lexforti.com\/legal-news\/if-the-accused-did-not-make-a-promise-with-the-sole-intention-of-seducing-to-commit-sexual-acts-such-an-act-would-not-amount-to-rape\/\" target=\"_blank\" rel=\"noreferrer noopener\">intention to commit rape <\/a>or attempt to commit rape.<\/p>\n\n\n\n<p>The court noted that according to victim\u2019s statement, the petitioner\u2019s act did not <a href=\"https:\/\/lexforti.com\/legal-news\/for-grant-of-temporary-injunction-the-party-filing-it-must-make-out-a-prima-facie-case\/\" target=\"_blank\" rel=\"noreferrer noopener\">prima facie<\/a> amount to rape or attempt to commit rape, and thus did not hold a case under Section 511 of IPC. However, the court observed that the <a href=\"https:\/\/lexforti.com\/legal-news\/to-attract-section-3004-ipc-the-act-should-be-utterly-inexcusable\/\" target=\"_blank\" rel=\"noreferrer noopener\">act might attract indecent assault punishable under Section 354<\/a> IPC.<\/p>\n\n\n\n<p>The court further elaborated that there exists fine distinction between preparation and attempt to commit any crime. The basis of this difference lies in the degree of determination, and thus observed that in order to prove \u201cattempt to commit rape\u201d, it should\u2019ve been shown that the accused had crossed the stage of preparation.<\/p>\n\n\n\n<p>The court also addressed the issue-whether the said <a href=\"https:\/\/lexforti.com\/legal-news\/pocso-act-will-apply-to-victims-even-after-attaining-majority-if-the-sexual-offence-was-committed-when-she-was-a-minor\/\" target=\"_blank\" rel=\"noreferrer noopener\">act formed an offence under Section 8 of POCSO Act<\/a>.
