{"id":10249,"date":"2021-08-24T15:30:00","date_gmt":"2021-08-24T15:30:00","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=10249"},"modified":"2021-08-24T15:30:32","modified_gmt":"2021-08-24T15:30:32","slug":"cci-holds-maruti-suzuki-guilty-for-involvement-in-unfair-business-practices","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/cci-holds-maruti-suzuki-guilty-for-involvement-in-unfair-business-practices\/","title":{"rendered":"CCI holds Maruti Suzuki guilty for involvement in \u201cunfair business practices\u201d"},"content":{"rendered":"\n<p>The Competition Commission of India (CCI) imposed a hefty penalty of Rs. 200 crores on Maruti Suzuki India Ltd. for its involvement in \u201cunfair business practices.\u201d The CCI held that Maruti Suzuki had restricted its dealers from offering discounts to the customers.<\/p>\n\n\n\n<p>According to the findings of antitrust regulator, MSIL had a \u201cdiscount control policy\u201d wherein it discouraged its dealers to give discounts more than the prescribed limit, along with freebies. Due to the actions and restrictions of MSIL, the CCI <a href=\"https:\/\/lexforti.com\/legal-news\/in-cases-of-appeal-the-order-passed-in-present-petitions-would-be-subject-to-any-order-passed-by-the-subordinate-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed a \u201ccease and desist\u201d order<\/a>.<\/p>\n\n\n\n<p>As per MSIL\u2019s policy, in case the dealers which to offer additional discounts, they had to take prior approval from the former. If any dealer had been found violating the fixed discount control policy, they were threatened with an imposition of penalty on dealership and on the<a href=\"https:\/\/lexforti.com\/legal-news\/the-preventive-detention-is-an-encroachment-upon-the-personal-liberty-of-an-individual-and-cannot-be-said-to-be-encroached-in-a-casual-manner-moreover-possibility-of-political-influence-cannot-be-ru\/\" target=\"_blank\" rel=\"noreferrer noopener\"> individual persons; regional manager, showroom manager, sales executive, team leader, etc<\/a>.<\/p>\n\n\n\n<p>Moreover, in order to keep enforce its policy, MSIL had appointed \u201cmystery shopping agencies\u201d who upon direction, posed as customers before MSIL dealerships and figured out whether any additional discounts were being offered to the customers or not.<\/p>\n\n\n\n<p>The CCI, in its order, mentioned that constant monitoring and enforcement of its policy through the mystery shopping agencies, hefty penalties, threats of strict actions like stoppage of supply, collection of penalty and its utilization, were the factors based on which MSIL had been held guilty.<\/p>\n\n\n\n<p>With respect to this order, the MSIL\u2019s spokesperson <a href=\"https:\/\/lexforti.com\/legal-news\/ex-parte-order-of-state-consumer-commission-can-be-challenged-before-ncdrc-hence-hc-will-not-exercise-its-extraordinary-writ-jurisdiction\/\" target=\"_blank\" rel=\"noreferrer noopener\">stated that it had examined the order<\/a> and would take steps for appropriate action under the law.
