{"id":10268,"date":"2021-08-28T15:01:20","date_gmt":"2021-08-28T15:01:20","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=10268"},"modified":"2021-08-28T15:01:45","modified_gmt":"2021-08-28T15:01:45","slug":"right-to-move-reside-throughout-the-country-cannot-be-denied-on-insubstantial-grounds-sc","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/right-to-move-reside-throughout-the-country-cannot-be-denied-on-insubstantial-grounds-sc\/","title":{"rendered":"Right to move\/reside throughout the country cannot be denied on insubstantial grounds- SC"},"content":{"rendered":"\n<p>The Apex Court, while quashing an externment order, observed that an individual\u2019s fundamental right to reside anywhere or move freely across the country cannot be taken away on unsatisfactory grounds.<\/p>\n\n\n\n<p>In the instant case, the Deputy Commissioner of Police, Amravati, had passed an externment order (keeping away from familiar environment where the criminal activities had been committed by an individual) against a journalist and directed him to leave the city of Amravati and not return for one year.<\/p>\n\n\n\n<p>The externment order had been passed in compliance to Section 56 of the Maharashtra Police Act, 1951, which specifically deals with removal of individuals who\u2019ve been anticipated to commit crime.<\/p>\n\n\n\n<p>The journalist contended before the Supreme Court that after it came to his knowledge that the public money distributed at Madrasas were being misappropriated, he had <a href=\"https:\/\/lexforti.com\/legal-news\/false-gangrape-men-woman\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed complaints<\/a> before the government. Further, in 2017, he requested the Collector to investigate upon this issue and later, filed a PIL as well.<\/p>\n\n\n\n<p>Thereafter, the externment proceedings had been initiated against him on the grounds that his movement and <a href=\"https:\/\/lexforti.com\/legal-news\/the-tribunals-having-exclusive-jurisdiction-to-one-act-must-take-the-primary-question-as-nature-of-case-and-can-proceed-only-if-satisfied\/\" target=\"_blank\" rel=\"noreferrer noopener\">acts were of calculated nature<\/a> to cause harm; anticipated that his acts might be prejudicial to maintenance of public order; and outbreak of epidemic had been as a result of continued residence of an immigrant.<\/p>\n\n\n\n<p>The bench observed that the drastic action of passing externment orders ought to be adopted in <a href=\"https:\/\/lexforti.com\/legal-news\/courts-will-only-interfere-in-a-consent-decree-if-there-exists-exceptional-circumstances-read-judgement\/\" target=\"_blank\" rel=\"noreferrer noopener\">exceptional circumstances<\/a> only, and with an aim to prevent breach of public tranquility and peace.<\/p>\n\n\n\n<p>However, the FIRs lodged against the appellant had been vindictive and retaliatory in nature, and the Madarasa people had been influenced to file FIRs merely to teach the appellant a lessor for stifling his voice.<\/p>\n\n\n\n<p>The bench <a href=\"https:\/\/lexforti.com\/legal-news\/can-a-transfer-order-be-quashed-on-the-ground-that-petitioner-is-afraid-of-getting-covid-19-infection\/\" target=\"_blank\" rel=\"noreferrer noopener\">quashed the externment order<\/a> and observed that the allegations raised against the appellant were doubtful in nature.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Apex Court, while quashing an externment order, observed that an individual\u2019s fundamental right to reside anywhere or move freely across the country cannot be taken away on unsatisfactory grounds.
