{"id":10345,"date":"2021-09-15T14:24:29","date_gmt":"2021-09-15T14:24:29","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=10345"},"modified":"2021-09-15T14:25:10","modified_gmt":"2021-09-15T14:25:10","slug":"delhi-hc-issues-notice-in-a-plea-seeking-action-against-google-pays-acts-contravening-article-21","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/delhi-hc-issues-notice-in-a-plea-seeking-action-against-google-pays-acts-contravening-article-21\/","title":{"rendered":"Delhi HC issues notice in a plea seeking action against Google Pay\u2019s acts contravening Article 21"},"content":{"rendered":"\n<p>The Delhi High Court, while hearing a Public Interest Litigation, issued notice against Google Pay as it had been alleged that its acts amounted to unauthorized access and storage of users Aadhar details.<\/p>\n\n\n\n<p>In the PIL, the petitioner alleged that Google Pay, which acts like a united payment interface for all the banks, violates most vulnerable right of individuals\u2019 safeguarded under Article 21 of the Constitution of India.<\/p>\n\n\n\n<p>Further, the petitioner alleged that the unauthorized access and storage by the application also violated Aadhar Act 2016, Banking Regulations Act 1949, and the Payments and Settlement Systems Act 2007.<\/p>\n\n\n\n<p>The petitioner, through his counsel, contended that the payment interface has not been registered or received license under the Payments and Settlement Act, 2007 in <a href=\"https:\/\/lexforti.com\/legal-news\/flyer-clash-a-digital-art-competition-by-centre-for-banking-and-finance-symbiosis-law-school-hyderabad\/\" target=\"_blank\" rel=\"noreferrer noopener\">order to legally<\/a> conduct business of payments and transactions.<\/p>\n\n\n\n<p>Moreover, information received from Reserve Bank of India stated that Google Pay had not attained the status of a registered bank, financial institution, or co-operative bank under the Act of 1949.<\/p>\n\n\n\n<p>It also had been submitted that the business activities of Google Pay had been operating in contravention of <a href=\"https:\/\/lexforti.com\/legal-news\/flyer-clash-a-digital-art-competition-by-centre-for-banking-and-finance-symbiosis-law-school-hyderabad\/\" target=\"_blank\" rel=\"noreferrer noopener\">banking as well as payment laws<\/a>. Even in the terms and conditions of the application, the petitioner pointed out that the company mentioned to store the payment instruction details of users.<\/p>\n\n\n\n<p>However, the UIDAI did not receive any <a href=\"https:\/\/lexforti.com\/legal-news\/rule-51-shall-not-have-any-application-for-further-investigation-under-section-1738-of-crpc\/\" target=\"_blank\" rel=\"noreferrer noopener\">application<\/a> from Google Pay to allow it to access, store, or use users Aadhar details.
