State of Sikkim, <\/strong><strong>MANU\/SI\/0036\/2019<\/strong><\/p>\n\n\n\n<p><strong>Case Brief-<\/strong><\/p>\n\n\n\n<p>According to Prosecution story, victim\u2019s husband filed lodged complaint\nstating that, while her wife was coming back from work to home, Sangay Bhutia\n(accused) appeared from the back of the victim and grabbed her, he, later on,\nassaulted her; while victim was shouting for help and consequently, she\nfainted. When she regained her consciousness, he left.<\/p>\n\n\n\n<p>The case was filed in the court of session and was charged under section\n376(1), 323 and 341. Accused denied all the charges. Accused was convicted by the\nfast track court under section 376(1), 323 and 341 of the Indian Penal Code,\n1860. <\/p>\n\n\n\n<p>The counsel of appellant contended that there were material discrepancies\nin the submission of the victim. She can not claim in totality that she was\nraped. There is no evidence to corroborate her claim and hence there can not be\nany basis for conviction. <\/p>\n\n\n\n<p>Counsel for the appellant relied on the case of <em>Ramdas v. State of Maharashtra,\u00a0<\/em><a href=\"http:\/\/scconline.com\/DocumentLink\/Vh4ng2zX\">(2007) 2 SCC 170<\/a>, where court held\nthat, <\/p>\n\n\n\n<p><strong>\u201cConviction in\na case of rape can be based solely on the testimony of the prosecutrix, but\nthat can be done in a case where the Court is convinced about the truthfulness\nof the prosecutrix and there exist no circumstances which cast a shadow of\ndoubt over her veracity.\u201d<\/strong><\/p>\n\n\n\n<p><strong>High Court\nconcluded that it is true that the sole testimony of victim is sufficient to\nconvict an accused, but without any medical evidence, court will have to\nexamine the witness more carefully. Moreover, victim\u2019s statement implies that\nshe is not sure if she was raped. <\/strong><\/p>\n\n\n\n<p><strong>Held-<\/strong><\/p>\n\n\n\n<p>Appellant is acquitted from the charge under Section\n376(1) along with the sentence being set aside, though the Court made it clear\nthat it would not mean that the prosecution case is totally false.
