Judicial Officer \u2018Subhas Bhattacharjee\u2019 filed a PIL,\nwhere he challenged the practice of Animal Sacrifice based on superstition,\nmainly in two temples i.e., \u2018Chatur Das Devata Temple\u2019 and \u2018Mata Tripureswari\nDevi Temple\u2019.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Submission_from_Petitioner_%E2%80%93\"><\/span><strong>Submission from Petitioner\n\u2013<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p><strong>\u00a0<\/strong>It was submitted that, on each day one\ngoat is sacrificed and on special occasions number of animals are sacrificed on\nthe name of offering Bali.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Submission_from_Respondent_%E2%80%93\"><\/span><strong>Submission from\nRespondent \u2013<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>Sacrificing Animals has been a long followed\ntradition as a Tantrik Method to worship \u2018Dash Maha Vidya\u2019.<\/li><li>Petitioner didn\u2019t challenge the sanctity of \u2018Bakri\nEid\u2019, hence it is a plot to disturb the Hindu sentiment and Public order in the\nstate.<\/li><li>When Tripura merged with the Indian Dominion,\nthe condition precedent was that State would worship Mata Tripureswari and ors,\nin the Traditional manner as has been followed way before Independence of India\nfrom British.<\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Held_%E2%80%93\"><\/span><strong>Held \u2013<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul><li>State\u2019s action to sacrifice animal on the daily basis is neither permissible by the Indian Constitution nor by any other Statute.<\/li><\/ul>\n\n\n\n<p><em>\u201cThe\nright of offering an animal for sacrifice is not an integral and essential part\nof the religion, protected under Article 25(1) of the Constitution. As such, no\nright of the freedom of professing any religion by the State can be said to\nhave been violated. State has no religion other than constitutionalism and the\nexpression &#8216;person&#8217; under Article 25 has to be in reference to natural person .\nWithdrawal of such practice would not tantamount to any change, fundamental in\ncharacter of the religion.\u201d<\/em><\/p>\n\n\n\n<ul><li>Animals have the Right\nto Life enshrined under Article 21 of the Constitution.<\/li><\/ul>\n\n\n\n<p><em>\u201cRight to\nlife now stands extended to all living beings, thus the expression\n&#8220;person&#8221; has to be read contextually. Hence, insofar as the life of\nan animal with which we are concerned, cannot be deprived, save and except, in\naccordance with the procedure established by law. What is that procedure\nestablished by law, now stands succinctly explained by the Constitution Bench\n(7 Judges) in <strong>Maneka Gandhi v. Union of\nIndia &#038; another, (1978) 1 SCC 248 <\/strong>which means due process of law.\u201d<\/em><strong><em>\n\u00a0<\/em><\/strong><\/p>\n\n\n\n<p><em>\u201cThe word &#8220;life&#8221; in Article 21 of the\nIndian Constitution is wide enough to include every living organism be it\nhumans, animals, insects or bird. Deprivation of life has to be as per\nprocedure established by law. Thus it is pertinent in this regard that\nsacrificing of animal and taking away of their life also has to be in\naccordance with due process of law. Sacrifice of animal in the manner and\nnature with which we are concerned, in the garb of religion, of which we are of\nthe opinion, is nowhere allowed by law. Only such practices can avail\nprotection under Article 25(1) which amounts to an essential and integral part\nof religion. In Jallikatu (supra) it stands observed that animals also have\nlife which also has to be protected under the purview of the said Article.\u201d<\/em><\/p>\n\n\n\n<ul><li>Matter\nregarding sacrifice by the minority community (Muslims) has already been\nsettled in the case of <strong><em>Mohd. Hanif Quareshi &#038; Ors. v. The State\nof Bihar.<\/em><\/strong><\/li><li>Traditional\nReligious Practice cannot override \u2018Prevention of Cruelty to Animals Act\u2019.<\/li><li>The\nmerger agreement has no reference of custom, ritual, tradition or any practice\nof animal sacrifice in the State of Tripura.<\/li><li>Sacrificing\nanimals is not the essential practice of the Religion.<\/li><\/ul>\n\n\n\n<p><em>\u201cAnimals\nalso breathe as humans and are sometimes said to have the same soul as humans.\nIn our considered view, sacrifice of an animal, based on superstition or not\nbeing an essential part of practice of religion in a temple is absolutely an\nantithesis to compassion.\u201d<\/em><\/p>\n\n\n\n<ul><li>There will be a negative impact upon the Child\u2019s mind.<\/li><\/ul>\n\n\n\n<p><em>\u201cA\nchild witnessing continuous violence towards animals may fail to inculcate\nmoral values of showing an act of love, kindness and compassion towards\nanimals. Sacrifice of animals in temples is not pleasing to the eyes and this\ninhuman religious practice in the name of religion has a definite impact on the\npsyche of a child.\u201d<\/em><\/p>\n\n\n\n<ul><li>Religion will be unaffected, even if the sacrifices are prevented.<\/li><\/ul>\n\n\n[wpdm_package id=&#8217;1282&#8242;]\n","protected":false},"excerpt":{"rendered":"<p>Sri Subhas Bhattacharjee v.
