Now India has \u2018The Trade Marks Act, 1999\u2019,\nwhich is in conformity with both the treaties now. It reflected as to how this\nglobal administrative laws actually bended the ongoing law prevalent then, in\nthe India. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"5_REFUGEE_PROTECTION\"><\/span><a>5.\u00a0\u00a0\u00a0\u00a0\nREFUGEE\nPROTECTION<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>The matter pertaining to the migration is important because it\ndenotes the importance of sovereignty. According to which under the sovereign\npower of the state, state will decide if the non-citizen of the country shall\nbe allowed to enter into the State or be compelled to leave.<a href=\"#_ftn91\">[91]<\/a>\nAfter second World War, the matter of Refugee got politicized to such extent\nthat UN\u2019s agency \u2018The International Refugee Organization (IRO)\u2019 was getting\nfunds only from the 18 countries out of 54 UN Members.<a href=\"#_ftn92\">[92]<\/a>\nIt is pertinent to understand that thousands of refugees were resettled under\nthe jurisdiction of IRO.<a href=\"#_ftn93\">[93]<\/a><\/p>\n\n\n\n<p>Later on, IRO was replaced by UN General Assembly to find the\npermanent solution to Refugees issue. The main reason is the decaying of\nthe sovereign attributes, after the introduction of International bodies. Now\nthrough collective efforts of nations, International bodies like U.N., can\nforce a Nation to be working under certain standards.\u00a0 <\/p>\n\n\n\n<p>Considering this aspect, the present paper has first defined the\nmeaning of Global Administrative System, then the meaning of Indian\nAdministrative System because the research is based upon the contrast in\nbetween these attributes. List of total five international bodies has been\nreferred, which authors believes to be the most influential bodies in their\ncounterpart functions, which have been also explained in brief.<\/p>\n\n\n\n<p>There are arrays of area which are being controlled by these\ninstitutions. Author has enlisted five such areas, which are having substantial\neffects upon an individual\u2019s life as well as sovereign status of a country,\nwhich are (i) Arms Control, (ii) Trade Law, (iii) Environmental Protection,\n(iv) Intellectual Property Rights and (v) Refugee Protection. These areas of\nGlobal Laws are crucial and there was a need to research upon these aspects.<\/p>\n\n\n\n<p>The enforceability part of the said rules, conventions, and treaties\ncomes from Indian Constitution only. Article 51 and Article 253 empowers the\nParliament to enforce such international instrument. Aspects like human right\nviolation arising from such enforcement are well within the control of the\nSupreme Court and if any laws are violative of Part III of the Constitution,\ni.e., Fundamental Rights, then it will get struck down by the Hon\u2019ble Court.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"7_SUGGESTIONS\"><\/span><a>7.\u00a0\u00a0\u00a0\u00a0\nSUGGESTIONS<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It is settled that, most of the times International Treaties which\nhave been ratified is for the welfare of the State as well as the World as a\nwhole. Weapon of mass destruction, environmental pollution, etc are not only\ndangerous to a State but to the whole world. It is also settled that,\nenforcement of International treaty most of the times goes to vain because of\ninaccuracy and feasibility issues pertaining to the process of \u2018Verification\u2019.\nAs has been stated Verification is the process in which the country gives the\nreport as to about the implementation of any treaties or rules.
