This\nnegligence cannot be treated to be misconduct. It would be pertinent to mention\nthat the enquiry officer has not found that there was any extraneous reason for\ngranting bail. The enquiry officer virtually sat as a court of appeal picking\nholes in the order granting bail.\u201d<\/em><\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading\" id=\"uagb-adv-heading-7915de45-0535-4ed1-89d8-c98516ad2ccf\"><h6 class=\"uagb-heading-text\"><span class=\"ez-toc-section\" id=\"Charge_2\"><\/span> <strong>Charge (2): <\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h6><div class=\"uagb-separator-wrap\"><div class=\"uagb-separator\"><\/div><\/div><p class=\"uagb-desc-text\"><\/p><\/div>\n\n\n\n<p>18\nadjournments were made for the production of 10 witnesses.<\/p>\n\n\n\n<div class=\"wp-block-uagb-advanced-heading\" id=\"uagb-adv-heading-76bb80f4-bcd1-4af7-9e93-61ba65dcbffc\"><h6 class=\"uagb-heading-text\"><span class=\"ez-toc-section\" id=\"Observation-2\"><\/span> <strong>Observation: <\/strong> <span class=\"ez-toc-section-end\"><\/span><\/h6><div class=\"uagb-separator-wrap\"><div class=\"uagb-separator\"><\/div><\/div><p class=\"uagb-desc-text\"><\/p><\/div>\n\n\n\n<p>No\ndisciplinary proceeding should be initiated merely because of incorrect orders.\n<\/p>\n\n\n\n<p><em>\u201cSuch a judicial officer is between the devil\nand the deep sea. If he keeps on granting adjournments then the High Court will\ntake action against him on the ground that he does not dispose of his cases\nefficiently and if he closes the evidence then the High Court will take action\non the ground that he has let the accused go scot-free. That is not the purpose\nof Article 235 of the Constitution of India.
