sample was taken from the\naccused, the Milk Fat was 4.6% and Milk Solid Non Fat was 7.7% which is not\nup-to the standards, that is 8.5%.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contention\"><\/span>Contention: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>There was a very minimal deviation from the settled food standard, when the sample was collected, due to which the benefit of doubt shall be given to the accused. <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Held\"><\/span>Held: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Once the standards have been made\nby the legislation, it has to be maintained.<\/p>\n\n\n\n<p><em>&#8220;In items\nlike milk which is a primary food, under the Act, it is not necessary to also\nprove that the food item had become unfit for human consumption or injurious to\nhealth. In cases of food coming under the Act, it is not required to prove that\narticle of food was injurious to health. In this case, the only question to be\ndetermined is whether the article complies with the standards laid down or not?\nIf it fails to comply with the standards then it will have to be treated as an\nadulterated article even if it is not rendered injurious to health. Even\nmarginal deviation from the prescribed standard cannot be ignored.&#8221;<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_referred\"><\/span>Case referred: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p><em>State of Kerala v. Parameswaran Pillai Vasudevan Nair,<\/em> where the\ncourt held that Act doesn\u2019t provide for exemptions if there is a marginal\ndeviation from the set standard.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contention-2\"><\/span>Contention: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>It was prayed before the Court to\nexercise powers under Article 142 of the Constitution as the cause of action\narose 20 years back.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Held-2\"><\/span>Held: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Court rejected the contention and\nheld that,<\/p>\n\n\n\n<p><em>\u201cWe are clearly of\nthe view that the power under Article 142 cannot be exercised against the\nspecific provision of law. Section 16(1)(a) of the Act lays down a minimum\nsentence of six months. Considering the bane of adulteration and the\ndeleterious effect of adulteration and substandard food on the health of the\ncitizens (especially children when milk is involved), the Legislature provided\na minimum sentence of six months. Passage of time can be no excuse to award a\nsentence lower than the minimum.\u201d<\/em><\/p>\n\n\n\n<p><em>\u201cFurthermore, the\npower under Article 142, in our considered view, cannot be used in total\nviolation of the law. When a minimum sentence is prescribed by law, this Court\ncannot, in exercise of its power under Article 142, pass an order totally\ncontrary to law. If such power could be used in a food adulteration case to\nimpose a sentence lower than the minimum prescribed, then even in cases of\nmurder and rape, this Court applying the same principles could impose a sentence\nless than the minimum. This, in our opinion, is not the purpose of Article 142.\nWe have no doubt in our mind that powers under Article 142 cannot be exercised\nin such a manner that they make a mockery of the law itself.\u201d<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Contention-3\"><\/span>Contention:\n<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>It was\nrequested to the Court to commute the sentence under Section 433 CrPC.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_referred-2\"><\/span>Case\nreferred: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p><em>Santosh Kumar v. Municipal Corporation.<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Held-3\"><\/span>Held: <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Court\nrejected the plea and held that, <\/p>\n\n\n\n<p><em>\u201cA bare perusal of\nSection 433 of Cr.PC shows that the powers under Section 433 can only be\nexercised by the appropriate Government. These powers cannot be exercised by\nany court including this Court. At best, the court can recommend to the State\nGovernment that such power may be exercised but the power of the appropriate\nGovernment cannot be usurped by the courts and the Government cannot be\ndirected to pass &#8216;formal compliance order&#8217;.
