{"id":226,"date":"2020-04-23T10:29:46","date_gmt":"2020-04-23T10:29:46","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=226"},"modified":"2021-01-17T12:16:21","modified_gmt":"2021-01-17T12:16:21","slug":"supreme-court-ordered-status-quo-on-cutting-of-the-trees-of-aarey-colony-in-mumbai-till-the-further-orders","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/supreme-court-ordered-status-quo-on-cutting-of-the-trees-of-aarey-colony-in-mumbai-till-the-further-orders\/","title":{"rendered":"Supreme Court ordered status quo on cutting of the trees of Aarey Colony in Mumbai, till the further orders."},"content":{"rendered":"\n<p><strong>Rohit Pradhan | 7th October 2019<\/strong><\/p>\n\n\n\n<p><strong>Background:<\/strong><\/p>\n\n\n\n<p>\u00a0Two judges bench comprising of Justice Arun\nMishra and Ashok Bhushan was constituted after numerous law students wrote\nletter to C.J.I Ranjan Gogai seeking urgent intervention by the Supreme Court\nto stop the cutting of the trees in the Aarey Colony.<\/p>\n\n\n\n<p>Previously Bombay High Court\nrejected the application, which seek to prohibit the cutting of trees in the\nAarey Colony on the ground that such issue had already been decided by a\nco-ordinate bench earlier.<\/p>\n\n\n\n<p>Petitioner pleaded for the \u2018stay\u2019\nuntil they approach the Supreme Court, as in the lieu of holidays, Petitioners\nmay cut the tree; but the said plea was rejected by the Bombay High Court.<\/p>\n\n\n\n<p>Curfew was imposed under Section\n144 CrPC, several protestors were arrested and authorities proceeded the cut\nthe trees in that region.<\/p>\n\n\n\n<p><strong>Counsel for the Stat<\/strong>e<strong>: <\/strong><\/p>\n\n\n\n<p>No further trees will be curt and\nthe legality of it can be decided by the environment bench after the Dusshera\nvacation.<\/p>\n\n\n\n<p><strong>Counsel for the Petitioner: <\/strong><\/p>\n\n\n\n<p>It was contended that the\nquestion as to, \u2018whether the Aarey is a forest or not\u2019 is pending before the\nSupreme Court. NGT is yet to decide if such area can be considered as an \u2018eco\nsensitive zone\u2019.
