Hence the\nState appealed before the Supreme Court to set aside the said judgment.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issue\"><\/span>Issue<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Whether the Gauhati High Court was correct to rule that, the\naccused must only be tried under MV Act and not IPC?<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Supreme_Court_ruling\"><\/span>Supreme Court ruling<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Judgment of the Gauhati High Court was set aside and held\nthat both the act operates with full vigour and they are independent. Even if\nthey are overlapping with each other at some point of instance, it won\u2019t make\nboth the statutes incompatible.<\/p>\n\n\n\n<p><em>&#8220;In our considered view the\nposition of law is well\u00ad settled. This\u00a0Court has consistently held that\nthe M.V. Act, 1988 is a complete\u00a0code in itself in so far as motor\nvehicles are concerned.\u00a0However, there is no bar under the M.V. Act or\notherwise, to try\u00a0and prosecute offences under the IPC for an offence\nrelating to\u00a0motor vehicle accidents.&#8221;<\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Court%E2%80%99s_reasoning\"><\/span>Court\u2019s reasoning<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<h6 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"1_On_compatibility_of_both_the_statutes\"><\/span><strong>1. On compatibility of both the statutes<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h6>\n\n\n\n<p><em>Court held that the ingredients for an offence in both the statutes are\ndifferent, hence both the Acts are not identical but independent.<\/em><\/p>\n\n\n\n<p><em>MV Act is silent when it comes to death or grievous hurt caused by by\nnegligent and rash driving, while IPC is very specific regarding these issued.<\/em><\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"2_On_proportionality_between_the_crime_and_punishment\"><\/span><strong>2.
