{"id":235,"date":"2020-04-23T10:29:46","date_gmt":"2020-04-23T10:29:46","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=235"},"modified":"2021-01-17T12:16:09","modified_gmt":"2021-01-17T12:16:09","slug":"trademark-granted-to-asahi-snow-beer-despite-opposition-by-china-based-brewery","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/trademark-granted-to-asahi-snow-beer-despite-opposition-by-china-based-brewery\/","title":{"rendered":"Trademark granted to Asahi \u2018snow\u2019 beer despite opposition by China based brewery"},"content":{"rendered":"\n<p><strong> Tejas Sateesha Hinder | National Law Institute University, Bhopal | 16th October 2019<\/strong><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Background<\/strong><\/h5>\n\n\n\n<p>Recently, Asahi Holdings\nUK Limited (hereinafter \u2018Asahi\u2019) has succeeded in obtaining a trademark in The\nUnited Kingdom, over the mark SNOW GLOBE, despite legal opposition from China\nbased brewery, China Resources Snow Brewery (Liao Ning) Company Limited\n(hereinafter \u2018China Resources\u2019), on the basis of rights acquired earlier in the\nmark SNOW, all of which were registered with regard to beverages covered under\nclass 32. The application being discussed is UK Application No. 3288786, filed\non 8<sup>th<\/sup> February, 2018 by Fuller Smith Turner &#038; Plc., later\nassigned to Asahi Holdings UK Ltd. The application for registration of the mark\nwas made by the company for alcoholic beverages, including beer, ale, lager,\nstout and porter.\u00a0 \u00a0\u00a0\u00a0<\/p>\n\n\n\n<p>Though this case may seem\nto be wrongly decided prima facie, brings back to light and emphasizes on\nfundamental but overlooked principles of trademark law. <\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Evidence of Usage<\/strong><\/h5>\n\n\n\n<p>The claim of China\nResources in the present case was that SNOW beer was the topmost beer brand in\nthe world, which appeared to be a claim made on considering its sales in China.\nIn addition to this, proof was provided by China Resources to indicate the\nlaunch of SNOW beer in the UK just before the filing of the contested\napplication, which also marked the end of the period of five years of usage. \u00a0<\/p>\n\n\n\n<p>A number of criticisms\nwere raised by the Hearing Officer with regard to the sale of SNOW beer in the\nUK before considering the genuine use of the mark granted. The invoices\nprovided showed that 7436 units were to be sold in the UK.<a href=\"#_ftn1\">[1]<\/a>\nHowever, the Hearing Officer deemed this to be fallacious due to absence of\nproof to indicate actual sales in the UK. The Hearing officer went on to state\nthat the opposition would have been justified in their claim if evidence such\nas production of accounts, turnover, invoices and receipts to retailers and\nconsumers, or even menus or price lists showing the goods offered for sale to\nsupport the claim the goods had been sold in restaurants were submitted in lieu\nof their claim, as the\u00a0 procurement of\nevidence of this nature would not have been difficult considering the nature of\nbusiness the opposition involved in.<\/p>\n\n\n\n<p>Further, the Hearing\nofficer also conceded to the fact that the five invoices, indicating the\nprospective sale of goods in the UK provided as evidence to support the\ncontention of genuine use of the mark in the UK.<a href=\"#_ftn2\">[2]<\/a>\nHowever, this very submission of China Resources, pointing towards genuine use\nin the UK could not satisfy the Hearing Officer with regard to the trademark\nregistrations over SNOW with the European Union, and hence were done away with\nduring further stages of examination<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><strong>Decision <\/strong><\/h5>\n\n\n\n<p>The decision was made by\nthe Hearing officer on the basis of registrations for marks on the same line as\nthe one applied for in the present case, and the same was considered to be the\nbest case of the opponents. <\/p>\n\n\n\n<p>In the present case, both\nthe marks in dispute were registered in relation to beer, and there was a\nsimilarity that the Hearing Officer could make out between the goods in dispute\nand deemed them to be very alike, thus dismissing the submission of the\nApplicants that beer was not similar to ale, lager, stout and porter, to also\ncover which the application for the mark was filed. Further, there was a visual\nand phonetic similarity between the marks that could be observed due to the use\nof the earlier mark SNOW before the mark applied for. Though there existed an\ninherent conceptual difference when considered, i.e. SNOW GLOBE had a meaning\ndifferent from SNOW, the similarity that struck the Hearing Officer was that\nboth the marks refer to something \u2018wintery\u2019. \u00a0<\/p>\n\n\n\n<p>Everything was going in\nfavour of China Resources till here, but the Hearing Officer, after this point\nseemed to turn towards Asahi when it was discovered that no possibility of\nconfusion arose despite the existing similarity in the goods as well as their\nmarks, owing to the fact that no independent or peculiar character was retained\nby SNOW within SNOW GLOBE, the mark applied for.<a href=\"#_ftn3\">[3]<\/a>\nAlso, if considered as a whole, SNOW GLOBE imparted a different meaning to\ncomponents when taken separately.
