This shall be done by analyzing the case of Justice Ranjan Gogoi \u2013 the 46<sup>th<\/sup> Chief Justice of India. <\/p>\n\n\n\n<div id=\"ez-toc-container\" class=\"ez-toc-v2_0_47_1 id=\"Events_that_led_to_the_allegations_against_Justice_Gogoi\"><\/span><strong>Events that led to the allegations against Justice Gogoi:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>On April 19, 2019, an affidavit was sent by a woman who was also a\njunior court assistant in the Hon\u2019ble Supreme Court under Justice Gogoi from 1<sup>st<\/sup>\nMay, 2014 till 21<sup>st<\/sup> December, 2018. This affidavit was sent to all\nthe Supreme Court judges in which she alleged being sexually harassed by\nJustice Gogoi. She stated that the CJI had touched her in inappropriate places and\nshe was further asked for sexual favors. After her denial, Justice Gogoi had asked\nher to be silent about the incident. He had threatened the former JCA that if she\ndisclosed this incident to anyone, her family would be greatly disturbed. In\nher affidavit, she had also stated the horrendous incidents that have occurred after\nthis incident which include her services getting terminated in December 2018, suspension\nof her husband and his brother, both of them who were head constables with the\nDelhi Police. Her husband\u2019s younger brother who had a job under the D category\nof the Supreme Court under the Chief Justice\u2019s discretionary quota was also\nterminated. Further, a frivolous FIR had also been lodged against her accusing\nher of bribery because of which she was arrested for two entire days. When the\nChief Justice got to know about these allegations, he called them \u201cbaseless\u201d\nwhich were designed to attack and erode the \u201cindependence of the judiciary\u201d. He\nfurther stated that in the judiciary profession, reputation is all they have\nand therefore such an accusation was a threat to the judiciary as a whole. <\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Procedure_in_which_the_interrogations_were_carried_on\"><\/span><strong>Procedure in which the interrogations were carried on:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Contending a threat to the \u201cindependence of judiciary\u201d Justice Gogoi constituted\na bench which included himself but not the senior-most judges after him. There\nwere no women judges on the Bench as well. The interrogations demanded the\ncomplainant not to share the proceedings with the media. It has also been\ncontended by the complainant that the interrogations demanded a reason for\ndelay of proceedings from her withstanding which there would be \u201cex-parte\u201d\nproceedings.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Why_wasn%E2%80%99t_the_procedure_justified\"><\/span><strong>Why wasn\u2019t the procedure justified?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>\u00a0According to Gender Sensitization\nand Sexual Harassment of Women at Supreme Court (Prevention, Prohibition and\nRedressal) Guidelines 2015, the rules on the Constitution of the Internal Sub-\nCommittee state that committee should constitute a fact-finding inquiry, which\nshall comprise of three members, with a majority being women and one\noutside\/external member.<a href=\"#_ftn1\">[1]<\/a>\nIn Justice Gogoi\u2019s case, initially there were two male members and one female\nmember which subsequently changed to two female members and one male member.\nThus, by doing so they adhered to the guidelines but even then, the internal\ncommittee failed to include any outsiders. <\/p>\n\n\n\n<p>The rules on Receipt of Written Complaint with supportive documents and\nstatement of witness states that the aggrieved woman will be required to file\nher written complaint either personally or through a volunteer as per\nRegulation 8 which should be accompanied by all supporting material, evidence,\ntranscripts and statements. It further states that the aggrieved woman shall\nsubmit a list of witnesses, along with their affirmed statements and contact\ndetails whom she desires to put in support of her case before the Internal\nSub-Committee.<a href=\"#_ftn2\">[2]<\/a> In\nthe present case, even though the complainant demanded legal representation,\nshe was denied so therefore violating these rules.<\/p>\n\n\n\n<p>The rules on Notice to the Respondent and Submission of Response in\nWriting state that within seven days of the receipt of a Complaint from the\naggrieved woman, the Member secretary shall serve the same along with enclosures\non the Respondent. It further states that the Respondent shall be called upon\nto place his written response along with the supporting material, and list of\nwitnesses within a period not exceeding seven days from the receipt of the\ncomplainant.<a href=\"#_ftn3\">[3]<\/a><\/p>\n\n\n\n<p>The rules on Reasonable Opportunity for the Complainant and the\nRespondent to present their case state that if the aggrieved woman desires to produce any\nadditional material or statement of any witness, which could not be submitted\nalong with the Complaint, the Internal Sub-Committee will permit the aggrieved\nwoman to do so, within such extended time as it deems appropriate. <a href=\"#_ftn4\">[4]<\/a>\nIn the present case, this stage wasn\u2019t reached as the respondent heard ex-parte\nproceedings, Therefore, the complainant was not given a reasonable opportunity\nto present her case.<\/p>\n\n\n\n<p>The rules on\n\u201cInquiry\u201d state that the internal sub-committee shall provide an opportunity to\nboth the parties and their respective witnesses, for an oral hearing and the\nhearing shall be duly \u201cvideo graphed\u201d.<a href=\"#_ftn5\">[5]<\/a>\nIt also states that the Member Secretary shall give three days (72 hours)\nadvance notice to the aggrieved woman, the Respondent and their respective\nwitnesses before a hearing is convened. Further, if the aggrieved women desire\nto be accompanied by a volunteer she shall convey the same to the Member\nsecretary. <a href=\"#_ftn6\">[6]<\/a> In\nthe present case, both these rules were not followed.<\/p>\n\n\n\n<p>The rules relating\nto Identity and confidentiality of Proceedings and Records state that\nnotwithstanding anything contained in the Right to Information Act, 2005, the\ncontents of the Complaint made under Regulation 8, the identity and address of\nthe aggrieved woman, Respondent, and witnesses, and any other information\nrelating to the Inquiry proceedings, recommendations of the Internal Sub- Committee,\nshall be kept confidential.<a href=\"#_ftn7\">[7]<\/a>In\nthe present case, the respondent\u2019s identity was known. Therefore, anonymity was\nnot followed.<\/p>\n\n\n\n<p>The rules of\ninterrogation state that the Internal Sub-Committee will not be precluded from\ntaking cognisance of any new fact, or evidence which may arise, during the\npendency of the inquiry proceedings, relating to the Complaint. <a href=\"#_ftn8\">[8]<\/a>\nIn the present case, even though it did not reach that stage but even after the\ncomplainant withdrew from the proceedings, the CJI was called.<\/p>\n\n\n\n<p>The rules relating\nto Ex- Parte proceedings state that The Internal Sub-Committee shall have the\nright to proceed ex-parte if the circumstances so warrant. In the event of the\nRespondent refusing to appear before the Internal Sub-Committee for three consecutive\nhearings, without valid justifiable ground, the Internal Sub-Committee shall\nproceed ex-parte against the Respondent on the basis of the material available\nbefore it. <a href=\"#_ftn9\">[9]<\/a>In\nthe present case, it is alleged that ex-parte proceedings were resorted to give\nthe respondent a clean chit. <\/p>\n\n\n\n<p>The rules relating\nto \u201cCompletion of the Inquiry\u201d state that The Internal Sub-Committee shall take\nall necessary steps to conduct and complete the fact-finding inquiry within a\nperiod of 90 days of the constitution of the Internal Sub-Committee as per\nRegulation 9(3).<a href=\"#_ftn10\">[10]<\/a>\nIn the present case, the enquiry was not completed within the given number of\ndays.<\/p>\n\n\n\n<p>Concluding these,\nit can be said that the procedure was not followed as per the Gender\nSensitization and Sexual Harassment of Women at Supreme Court (Prevention,\nProhibition and Redressal) Guidelines 2015.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Is_natural_justice_applicable_in_India\"><\/span>Is natural justice applicable in India?<span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The eternal absolute principles of natural justice may be summarized as\nfollows;<a href=\"#_ftn11\">[11]<\/a><\/p>\n\n\n\n<ol><li>Opportunity\nfor both the parties to be heard.<\/li><li>Hearing before\nan impartial tribunal so that no man can be judge of his own cause.<\/li><li>Decision\nmade in good faith.<\/li><li>The party\nagainst whom evidence is obtained, must be given an opportunity to contradict\nit.<\/li><\/ol>\n\n\n\n<p>The same idea has been expressed by Hood Philipci as\nwell in the following ways;<a href=\"#_ftn12\">[12]<\/a><\/p>\n\n\n\n<ol><li>No one\nshall be a judge in his own cause.<\/li><li>The\njudges deciding are bound to hear the other side.<\/li><li>The trial\nmust be in good faith without bias and not arbitrarily or unreasonably.<\/li><\/ol>\n\n\n\n<p>Further, natural justice has been filtered into the Indian Judicial\nSystem as well into the Articles 14, 19 and 21 of the Constitution which\nprotects the individual liberties and rights of civil servants. Article 136\nalso envisages natural justice. Through this article, the Supreme Court can\nconfer a special leave petition. Some members of the Constituent Assembly have\nunderstood it as bringing natural justice within the realm of the Supreme\nCourt. Thus, Shree AlladiKrishnaswamiAiyer said in the Constituent Assembly; <a href=\"#_ftn13\">[13]<\/a><\/p>\n\n\n\n<p>\u201cIt is necessary to realize the comprehensive nature and the plentitude\nof the jurisdiction conferred by the Article 136. The Supreme Court is free to\ndevelop its own rules and conventions in exercise of its jurisdiction. There is\nnothing preventing the Supreme Court from developing its own jurisprudence in\nsuch a way that it could do complete justice in every kind of cause or matter\u201d\nThe Supreme Court has observed the notion of natural justice in procedural\nmatters as well. In fact, there are some cases in the Supreme Court applied\nnatural justice as a fundamental basis of its decision. Some of them are\nsummarized as follows;<\/p>\n\n\n\n<p>In the case of P. John v. State of Travancore Cochin,<a href=\"#_ftn14\">[14]<\/a>\nthe civil servant concerned was the chief engineer. An enquiry was made against\nthe officer. A copy of report was given to the officer and he was asked to show\nwhy he would not be removed from service, and he did not do so. The supreme\ncourt held that the opportunity that was given to the officer to show cause was\nsufficient but Mahajan, C.J observed that all the rules of natural justice were\nfully observed during the enquiry in this case and the petitioner had the\nfullest opportunity. This principle was further observed in the cases of Union\nof India v. T.R. Verma<a href=\"#_ftn15\">[15]<\/a>\nand Khemchanda v. Union of India<a href=\"#_ftn16\">[16]<\/a>.\nAnother remarkable application can be observed in the case of Mukhtar Singh v.\nState of U.P <a href=\"#_ftn17\">[17]<\/a>\nwhere the division bench laid down that the principles of natural justice are\nthe rules that offer minimum protection of rights against the arbitrary\nprocedure that may be adopted by a judicial or quasi-judicial authority.<\/p>\n\n\n\n<p>In the case of Sangram Singh v. Election Tribunal<a href=\"#_ftn18\">[18]<\/a>,\nJustice Bose said,<\/p>\n\n\n\n<p>\u201cA law of natural justice exists in the sense that a party must be heard\nin a Court of law, or at any rate be afforded an opportunity to appear and\ndefend himself, unless there is an express provision to the contrary, is we\nthink beyond dispute\u201d In the case of Nageswar Rao v. State of A.P. <a href=\"#_ftn19\">[19]<\/a>\nit was objected that the chief minister being a party could not be a judge in\nhis own cause and that the chief minister having prejudiced had no fair mind\nand as such was disqualified to act i.e. it was against the principles of\nnatural justice.<\/p>\n\n\n\n<p>In the light of the above cases it can be stated that the principle of\nnatural justice was applied by the Supreme Court.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_did_the_procedure_followed_in_this_case_violate_Natural_justice\"><\/span><strong>How did the procedure followed in this case violate Natural justice?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>In the previous paragraphs, we have already stated how the procedure\nfollowed was not according to the procedure stated in law. Now, we shall\nanalyze how it violated natural justice. The eternal principles of natural\njustice state that no man can be a judge in his cause. Justice Vivian Bose in a\ncase of District Superintendent of Police had squashed the proceedings stating\nthat the DSP had acted both as a judge and a witness therefore enforcing the\nprinciple of natural justice. In the present case, when faced with sexual\nharassment allegations Justice Gogoi constituted an internal committee which\nincluded him and two other male judges including the Attorney General who would\nspeak on his behalf. By doing so he violated the first principle of natural\njustice. The second principle states that a both the parties should be given an\nopportunity to be heard. In the present case, when the complainant was not\ncomfortable with the Justice Gogoi being a judge in his own cause, she delayed the\nproceedings and subsequently withdrew from it because of which ex-parte\nproceedings had started and the complainant was not given a reasonable\nopportunity to be heard. The third and the most important of all the principles\nis that the decision should be in good faith. But if a man is a judge in his\nown cause and ex parte proceedings have taken place which further adds to not\ngiving the other party a reasonable chance to be heard, the chances of the\ndecision being impartial is substantially less. Therefore, concluding this, it\ncan be said that the procedure adopted by Justice Gogoi violated all the\nprinciples of natural justice and therefore was against the law.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Justice_Gogoi%E2%80%99s_remarks_after_violating_Natural_justice\"><\/span><strong>Justice Gogoi\u2019s remarks after violating Natural justice<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Justice Gogoi made several statements through which it can be inferred\nthat he tried asserting \u201cindependence of judiciary\u201d over \u201cnatural justice\u201d.<\/p>\n\n\n\n<p>Some of the statements he made are; <\/p>\n\n\n\n<p>\u201cRise of populism presents a challenge to independence of courts and\nasked the judiciary to standup against populist forces and protest\nconstitutional ethos\u201d<\/p>\n\n\n\n<p>He further added, this is also an area that requires the judiciary to\nprepare itself, to strengthen itself against such populist onslaughts on the\n\u201cindependence\u201d of the institution.<a href=\"#_ftn20\">[20]<\/a><\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Does_asserting_%E2%80%9Cindependence_of_judiciary%E2%80%9D_make_you_judicially_accountable_as_well\"><\/span><strong>Does asserting \u201cindependence of judiciary\u201d make you judicially accountable as well?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>In India, Judiciary is considered to be the most important organ of the\ngovernment. The two other organs, the legislature and the executive are even\naccountable to the judiciary. But the real question that arises is who is the\njudiciary accountable to?<\/p>\n\n\n\n<p>In India, a judge has never been impeached. Does that give judiciary\nabsolute power amongst the several organs? Furthermore, \u201cindependence of\njudiciary\u201d is also considered to be one of the basic structures of the\nConstitution. But does that give the Indian judiciary an excuse to get away\nwith their crimes? We shall analyze these through these cases.<\/p>\n\n\n\n<p>In the present case as we have already noted, when Justice Gogoi was\nfaced with sexual harassment charges, he denied so asserting the allegations\nwere a threat to the \u201cindependence of judiciary\u201d Furthermore, as we have\nalready noted a lot of immunities were given to the Chief Justice as well. The\nprocedure in which the interrogations were conducted did not abide by theGender\nSensitization and Sexual Harassment of Women at Supreme Court (Prevention,\nProhibition and Redressal) Guidelines 2015. This is not the only case where\nsuch immunities have been granted.Recently, a retired Supreme Court judge AK\nGanguly was accused by an intern for sexually harassing her. Later on, he was\neven found guilty. But after that all he had to do was resign from the West\nBengal Human Rights Commission. There weren\u2019t any substantial charges against\nhim. In another case, a Madhya Pradesh High Court judge was found guilty of\nsexually harassing a woman. 58 resolutions were also passed by the Rajya Sabha\nMP\u2019s to impeach the judge yet no severe action was taken against him. These\ncases are a clear indicative of judiciary misusing the power given to them.\nThese cases further imply that there is a dire need to hold the judiciary\naccountable for their acts and further restore the citizens faith in them.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"How_can_the_judiciary_be_held_accountable_for_their_actions\"><\/span><strong>How can the judiciary be held accountable for their actions?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>Here, we will finally discuss the measures that can be taken in order to\nhold the judiciary accountable for their actions. This shall ensure reasonable\npower in the hands of the judiciary. Furthermore, even \u201cindependence of\njudiciary\u201d in its truest sense shall be procured. Firstly, there should be an\ninvestigative body that should ensure wider representation of members and not\njust the judges. The members can be elected from the leading political parties\nand their oppositions. There can also be members from the various commissions\nsuch as the Chairperson of the National Human Rights Commission. By doing this,\nthe investigation\/interrogation procedure shall take place in a fair\/justified\nmanner. There would be less probability of a judge influencing a decision\nbecause of its position\/the power it holds. Further, a bill should be\nintroduced which shall provide a mechanism for the procedure for investigation\ni.e. whenever there is a complaint against a judge. All the investigating\nprocedure should be made public.Further, the contempt charges should be taken\nup by independent bodies rather than the courts. And the most important of all\nthe measures is Judicial Restraint. Judicial Restraint deals with limiting the\npower of the judges. In the present case, we have observed that since Justice\nGogoi had unlimited power in his hands, he conducted an interrogation which was\nfavorable for him therefore violating fairness, natural justice and good conscience.\nThese measures shall be a step ahead in procuring Judicial accountability which\nin today\u2019s era is very much needed.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>By analyzing this case, we can infer that \u201cindependence of judiciary\u201d is\nbeing misused by the Indian judges. There is a dire need for an investigative\nbody\/a law that ensures that the power given to these judges is utilized in a\nfair and reasonable manner. If not, then power will prevail over justice. If\nthat happens, there will be no democracy which has been acquired after several\nhardships.
