Ombir Singh v. State of Madhya Pradesh (Criminal Appeal No. 982 of 2011)<\/strong><\/p>\n\n\n\n Facts <\/strong><\/p>\n\n\n\n The Appellant in this case challenged the verdict given by the High Court of Allahabad finding him guilty under section 302 read with section 34 of the Indian Penal Code and section 27 of the Arms Act. The High Court found him guilty of murdering one, Abhaiveer Singh Bhadoria and sentenced him to life imprisonment and a fine of Rs 11,000\/-. The question of the victim\u2019s death being a homicidal death was undisputed as the autopsy report made it clear that the victim dying due to five bullet wounds. The prime argument of the Appellant is that the brother of the victim and original complainant, Dinesh Singh and Mukesh Singh were unreliable witnesses.
