class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"INTRODUCTION\"><\/span>INTRODUCTION<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Recently the Government of India\nhad passed an ordinance to ban the import, export and advertisement of sale of\nE-cigarettes in the country. The contention made by the Government is that sale\nof e-cigarettes is adversely affects the youth of the country and passed the\nordinance in public health interest.\u00a0 Electronic\ncigarette are battery operated devices that produce aerosol by heating a\nsolution containing nicotine<a href=\"#_ftn1\">[1]<\/a>,\nwhich is the addictive substance in combustible cigarettes<a href=\"#_ftn2\">[2]<\/a>.\nThese includes all forms of electronic nicotine delivery system heat not burn\nproduct, e hookah and similar device<a href=\"#_ftn3\">[3]<\/a>.\nIt is a technology which consist of a prefilled and refillable cartridge which\ncontains nicotine in liquid form other e-liquids, an atomizer, a heating\nelement and a battery. By inhaling, the liquid present in e-cigarettes starts\nheating and forms vapour which give effect as like tobacco products. It\nreplaces the use of conventional cigarettes, by burning of tobacco. These\ne-cigarettes are less harmful to heath of the consumer than that of\nconventional cigarettes<a href=\"#_ftn4\">[4]<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"HARMFUL_EFFECTS_OF_E-CIGARETTES\"><\/span>HARMFUL EFFECTS OF E-CIGARETTES<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>The formation of Formaldehyde-releasing agents\nduring the period of heating and vaporization of e-cigarette liquid leads to\nformation of cancer.<a href=\"#_ftn5\">[5]<\/a>\n<\/li><li>The presence of propylene glycol in e-cigarettes\nwhich is a known irritant, the inhalation of propylene glycol may cause breathing\ndisorders and problems such as asthma and other inflammatory respiratory\ndiseases.<a href=\"#_ftn6\">[6]<\/a><\/li><li>The use of E-cigarettes give addiction and rise\nto exposure to nicotine and other toxicants from passive and continuous\nsmoking.<a href=\"#_ftn7\">[7]<\/a><\/li><\/ol>\n\n\n\n<p>In a study, negligible levels of\nformaldehyde were released at lower EC [e-cigarette] setting and that high\nlevels of formaldehyde were only released under unrealistic experimental conditions,\nor specifically during &#8220;dry puffs<a href=\"#_ftn8\">[8]<\/a>.&#8221;&#8216;\nIt is concluded after reviewing a number of other studies that &#8221; although\ne-liquid can be heated to a temperature which leads to a release of aldehydes,\nthe resulting aerosol is aversive to vapers and so poses no health risk.<a href=\"#_ftn9\">[9]<\/a><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BENEFITS_OF_E-CIGARETTES\"><\/span>BENEFITS OF E-CIGARETTES<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>There are claims that e-cigarettes\nare less harmful than traditional tobacco products and that e-cigarettes could\nhelp smokers to quit. However, such evidence is considered limited and\ninconclusive up to now<a href=\"#_ftn10\">[10]<\/a>.\nThe presence of nicotine in e-cigarettes is less in amount as compared to\nconventional cigarettes which is less harmful. As we know that e-cigarettes\nmuch safer than that of conventional cigarettes, thus, complete ban on\ne-cigarettes will deprive the consumer to more harmful smoking alternative like\nconventional cigarettes. The precautionary principle<a href=\"#_ftn11\">[11]<\/a>\nexplains that eliminating the potential benefits of e-cigarettes is potential\nharm for current smokers.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"BANNING_OF_E-CIGARETTES\"><\/span>BANNING OF E-CIGARETTES <span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>The banning of e-cigarettes by\nIndian Government is not complete solution to restrict the use of it. There are\nother various tobacco products such conventional cigarettes, marijuana, gutkha,\nkhaini, jarda and products which contains high amount tobacco and nicotine\nwhich has to be banned but these products are easily available in the market\ninstead of banning these products the banning e-cigarettes is not justified. When\nthe supply of e-cigarettes reduced then demand for the traditional cigarettes and\nsubstitute goods increases in the consumers of e-cigarettes. <\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_I_WHY_E-CIGARETTES_MUST_NOT_BE_BANNED_IN_INDIA\"><\/span>\u00a0\u00a0\u00a0\u00a0\u00a0 I.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\nWHY E-CIGARETTES MUST NOT BE BANNED IN INDIA.<span class=\"ez-toc-section-end\"><\/span><\/h6>\n\n\n\n<p>The background\non which the centre has passed the ordinance to ban e-cigarettes seems a\ndecision taken in haste. The proposed health concerns which is cited to be the\nreason for the ban comes out to be empirically vague and unjustified. There is\nno concrete data and research available yet which has tabulated the projected\nhealth risks involving use of vaping and e-cigarettes. The genesis of all this\ne-cigarettes hoopla comes from the demise of six people in the United States of\nAmerica along with four hundred fifty people suffering from a serious pulmonary\ndisease which is yet undiscovered and is linked to e-cigarettes. In the USA,\nthe vaping and e-cigarette companies which allege e-cigarettes to be less\nharmful than traditional tobacco cigarettes need to provide the FDA (Food and\nDrug Administration) with proper evidence to substantiate their point.<\/p>\n\n\n\n<p>The Indian\nscenario stands differed in this regard. All the data relied upon for the ban\nof e-cigarettes is undergirded by the data of the US. The concern of young\npopulation consuming e-cigarettes is also of the US population and not of the\nIndian population. 100 million people smoke traditional tobacco, while 300\nmillion people consume tobacco by chewing them. Tobacco is the core cause of\nthe posed health issues such as cardio-vascular disease, lung cancer, mouth\ncancer and respiratory diseases. Framework Convention on Tobacco Control (FCTC)\nis the convention which keeps a check on the world tobacco usage. India is a\nsignatory to the mentioned Convention. Tobacco consumption in India has become\na part and parcel for the one consuming it. A very few sections of the tobacco\nconsumers are exposed to the new generation e-cigarettes, the reason being\nthese e-cigarettes are sold online and are not available on conventional retail\nshops. Indian Policy makers must not target E-cigarettes with such a tough\nblow. E-cigarettes are just one of the many forms of smoking devices or\ncommodities available in the Indian market. Moreover, the alleged health\nconcerns are not backed by any data tabulated by Indian researchers dealing\nwith the India Population. This is the major flaw in the hasty ordinance\npassed. Also, we cannot miss on the fact that India was a potential future\nmarket for the major vaping companies like Juul Labs and Phillip Morris\nInternational which had their intentions locked to invest in India. This might\nfurther degrade the already stumbling Indian Economy. \u00a0<\/p>\n\n\n\n<p>While giving a\nconstructive analysis regarding the ban, we being meticulous in our approach,\nwe cannot ignore the benefits which the traditional companies are reaping due\nto it. Companies like ITC and Godfrey Philip saw exponential rise in the stocks\nat the Bombay Stock Exchange. In an interview with Riccardo Polosa, professor\nat department of clinical and experimental medicine, University of Catania,\nItaly, stated that nicotine doesn\u2019t cause Lung Cancer or Cardio-vascular\ndisease or Pulmonary disease, it is Tar which causes the disease.<a href=\"#_ftn12\">[12]<\/a>\nAccording to him toxicological tests on these new products that check the level\nof toxins or carcinogens in aerosols would result in a 90-99% less of what\nwould be found in traditional tobacco smoke.<a href=\"#_ftn13\">[13]<\/a>\nThe Indian\u00a0 market does not have any\ne-cigarette manufacturers. <\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_II_THE_FARMER%E2%80%99S_AND_THE_E-CIGARETTES\"><\/span>\u00a0\u00a0\u00a0 II.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\nTHE FARMER\u2019S AND THE E-CIGARETTES.<span class=\"ez-toc-section-end\"><\/span><\/h6>\n\n\n\n<p>Farmers are clamorously\nagainst the production of e-cigarettes. There main concern is the harm which\ntheir tobacco production bears due to these vaping technique\u2019s which are the\nnew generation products. The farmers are already oppressed by heavy taxation\nand other burdens and thus they do not support the consumption of e-cigarettes.\nAs already explained e-cigarettes are ENDS (Electronic Nicotine Delivery\nSystem) and use only Nicotine. Indian markets have no such methods to extract\nthe required Nicotine to manufacture e-cigarettes. Thus, the farmers tobacco is\nexported and the production of e-cigarettes do not help farmers in any manner\nwhatsoever.<\/p>\n\n\n\n<p>The\nProtectionist discrimination adopted by U.S. law banning clove cigarettes on\none hand and leaving domestically produced methanol on the other hand raises\nthe rising concern about proper policy implementation in relation with e-cigarettes.\nIn the clove cigarettes case\u00a0Indonesia\nalleged that Section 907, which was signed into law on 22 June 2009, prohibits,\namong other things, the production or sale in the United States of cigarettes\ncontaining certain additives, including clove, but would continue to permit the\nproduction and sale of other cigarettes, including cigarettes containing\nmenthol. \u00a0 Indonesia alleged that Section 907 is inconsistent, inter alia,\nwith Article III (4) of the GATT 1994, Article 2 of the TBT Agreement, and\nvarious provisions of the SPS Agreement.<a href=\"#_ftn14\">[14]<\/a>\nThe protectionist discrimination was the bone of contention. The case gives us\ndirections to sculpt our policies regarding e-cigarettes in such a fashion as\nto not allow other countries policies burden our economy.<a href=\"#_ftn15\">[15]<\/a><\/p>\n\n\n\n<h6 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"_III_THE_ENVIONMENTAL_CONCERNS_ATTACHED_WITH_E-CIGARETTES\"><\/span>\u00a0III.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\nTHE\nENVIONMENTAL CONCERNS ATTACHED WITH E-CIGARETTES.<span class=\"ez-toc-section-end\"><\/span><\/h6>\n\n\n\n<p>With the recent climatic changes, we\ncannot afford to rule out the possibility of e-cigarettes causing environmental\nharm. The e-waste generated is a major concern. The e-waste generated by\ne-cigarettes is no less. The waste generated is shipped from western countries\nto developing nations. The developing countries are blatantly used as dumping\ngrounds which places major environmental hazards. The e-cigarettes\u2019 residue\nincludes nicotine filled pods containing plastics, nicotine residue and\nelectronic circuitry which are qualified hazardous waste. The disposable\ne-cigarettes are used for a short period of time and pose highest environmental\ncost. The residue also contains heavy metals such as mercury, bromines lead and\nbattery acid, which causes immense harm to the soil quality. However, we must\nnot sway away from the fact that e-cigarettes must not come under the ambit of\ntobacco products. E-cigarettes do not use tobacco. They use nicotine. In\nIndia, E-waste is covered in Schedule 3 of \u201cThe Hazardous Wastes (Management\nand Handling) Rules, 2003\u201d<a href=\"#_ftn16\">[16]<\/a>.\nUnder Schedule 3, E-waste is defined as \u201cWaste Electrical and Electronic\nEquipment including all components, sub-assemblies and their fractions except batteries\nfalling under these rules.\u201d<a href=\"#_ftn17\">[17]<\/a> The framework regulating\ne-cigarettes must not derive its power from other tobacco-controlling issues.\nThe government of India has taken sound decisions in the law making to regulate\nhazardous waste in India. Poor implementation of these laws and unawareness in\nthe lower strata of the Indian population has resulted in e-waste to as a\npotential monster. Public health laws are the legal tools that populations\nutilize to \u201cassure the conditions for people to be healthy.\u201d<a href=\"#_ftn18\">[18]<\/a><\/p>\n\n\n\n<p>Although many public health laws in the twentieth century targeted NCDs,\nboth the scholarly and popular critique of public health laws in this century\nhave largely focused on laws addressing obesity and, to a lesser extent,\nsmoking.<a href=\"#_ftn19\">[19]<\/a> To critics, the obesity\nepidemic is largely the result of individual choices, such as whether to\nexercise or to eat fast food.<a href=\"#_ftn20\">[20]<\/a> At least when made by competent adults, critics contend, those\nindividual choices should be respected.<a href=\"#_ftn21\">[21]<\/a> Laws seeking to prohibit or even\nalter individual choices do not address public harms, rather they are\npaternalistic attempts by the state to interfere in an individual\u2019s choice for\nthe individual\u2019s own good.<a href=\"#_ftn22\">[22]<\/a> <\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"RECOMMENDATIONS_AND_SUGGESTIONS\"><\/span>RECOMMENDATIONS\nAND SUGGESTIONS<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Ban is not a solution but the regulation put more impact on the trade of\nE-Cigarettes. That to take so hastily without studying the future aspects\nrelated to the market and sale of such products along with the revenue\ngenerated. When economics comes into play, we must consider each and every\naspect of the actions taken by the government. E-cigarettes as well as\ntraditional tobacco cigarettes are demerit goods. Interdiction of E-cigarettes\nkills innovation and hampers availability of substitutes which will eventually\nincrease the demand of traditional cigarettes. This will incur a major health\ncost on the society. Also, illegal trade has reached to $25.7 billion. Instead E-cigarettes\nmust be regulated along with other tobacco products. But e-cigarettes should\nnot be treated explicitly as a tobacco product as it also comes under the ambit\nof electronic machine.<\/p>\n\n\n\n<p>The World Health Organization (WHO) Study Group on Tobacco Product\nRegulation gave its first report in 2009 where it addressed the concern about\ne-cigarettes and advised a precautionary approach since not much study was done\nregarding the cessation and safety and harm reduction efficacy of e-cigarettes.<a href=\"#_ftn23\">[23]<\/a>\nE-cigarettes should be regulated, but not be subject to the same rules as\nmedicinal products unless they are presented as having curative or preventive properties.\nThose for which no such claims are made should contain no more than 30 mg\/ml of\nnicotine, should carry health warnings and should not be sold to anyone under\n18 years old.<a href=\"#_ftn24\">[24]<\/a><\/p>\n\n\n\n<p>Banning is certainly not a prudent action as it compels the smoking population\nto divert towards conventional smoking or tobacco products to meet their daily\nnicotine urges. The Tobacco economy in India is large compared to many other\ncountries. An approximate of 10% of the world\u2019s tobacco smokers are in India.\nThis poses a huge concern about the public health at large since banning\ne-cigarettes means shoving the population to greater health hazards caused by\ntobacco products. The ban is also strangulating potential employment in this\nindustry. Allowing construction of a proper e-cigarette industry regulated by\nrules and restrictions would not only boost Indian Economy but will also\nresolve the employment hue and cry to some extent. This will also help\ne-cigarettes to come up as legal alternative to the much harmful traditional\ncigarettes. The ban is indirectly playing a major role in corroding Public\nHealth which seems to be incoherent with the proposed motive of the Government\nregarding the justification of the ban imposed. The most effective way\nto reduce tobacco use is to raise the price of tobacco through tax increases.\nHigher prices discourage youth from initiating cigarette smoking and encourage\ncurrent smokers to quit.\u00a0 Same methods of\nproper taxation can be employed for e-cigarettes as well. Studies of price\nelasticities in India find that a 10% increase in tobacco prices is estimated to reduce bidi\nconsumption by 9.1% and\ncigarette consumption by 2.6%.<a href=\"#_ftn25\">[25]<\/a><\/p>\n\n\n\n<p>Regulatory measures regarding\ne-cigarettes should primarily address Quality Standards and monitoring of\ne-cigarettes and e-liquids and should require the following: (1) evidence that good manufacturing practice\n(GMP) has been followed; (2) child-proof caps on fluid containers; (3) official\ndocumentation reporting on the contents of e-cigarette fluids to regulators;\n(4) clear, accurate and detailed labelling about the contents and the hazards\nassociated with e-cigarette use.<a href=\"#_ftn26\">[26]<\/a><\/p>\n\n\n\n<p>The regulation of was not spared\nfrom debates over their consumption as either drug delivery devices or tobacco\nproducts. In <em>Sottera Inc. v. Food and Drug\nAdministration<\/em><a href=\"#_ftn27\">[27]<\/a>the court held that e-cigarettes could\nnot be regulated as drug delivery devices since they were not being marketed\nfor therapeutic purposes such as smoking cessation. However, the court held\nthat the FDA could regulate it under Tobacco control authority. However, it\u2019s a\nlong way ahead for India. In our context we must not restrict our regulations\ntill tobacco control. Regulations concerning the electronic aspect of the\ne-cigarettes must not be ignored.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"CONCLUSION\"><\/span>CONCLUSION<span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>With the various authorities cited\nthe authors of this article unequivocally conclude that the ban on e-cigarettes\nis no less than juxtaposing the contraries. On one hand governments motive is\nto curb the use of tobacco and similar products while on the other hand by\nbanning e-cigarettes they have closed the gates to a relatively safer\nsubstitute to the tobacco products. This decision taken so hastily without the\nsupport of proper empirical data and research highlights the sorry state of\naffairs. We have provided the rationale behind the benefits of having\ne-cigarettes as an alternative. The research question of the ambiguity attached\nwith the ban has been dealt with. Concluding it the authors would like to\nremark that e-cigarettes has a potential market in India and its sale must be\nlegalised in accordance with the recommendations mentioned along with other\npossible recommendations. Reiterating it, banning it is not the most prudent\nway to deal with it. Regulations and Policy Implementation is the proper\nsolution. The vexed question of e-cigarettes to be hazardous stands negated.\nEconomics and law fail miserably in this dastard decision taken by the\ngovernment. It is also clearly stated that the authors are not advertising and\nsupporting e-cigarettes. This research only criticises the ban imposed on them.\nWe agree that tobacco products as well as e-cigarettes come under the ambit of\ndemerit goods. Their consumption should be tactically regulated to promote\npublic health at large. The environment of E-Cigarettes in India is different\nthan other countries, E-Cigarettes should be regulated less aggressively than\nthe traditional tobacco product in India, Major concern of the government is to\nlower the rate of the tobacco in the country.
