State of Punjab., CRIMINAL\u00a0APPEAL\u00a0Nos.\u00a01492 \u00ad- 1493\u00a0OF\u00a02010<\/strong> <\/p>\n\n\n\n<p><strong>Matter:<\/strong><\/p>\n\n\n\n<p>Four accused including appellant is charged under Section\n304-B\u00a0\u00a0 and\u00a0\u00a0 Section\u00a0\u00a0\n498\u00acA\u00a0\u00a0 of\u00a0\u00a0 the\u00a0\u00a0\nIndian\u00a0\u00a0 Penal\u00a0\u00a0 Code 1860. Appellant herein is husband of\ndeceased. The\u00a0\u00a0 trial\u00a0\u00a0 Judge, therefore, convicted\u00a0\u00a0 the appellant and his father and mother for\nthe offence punishable under Section 498\u00adA of the IPC and sentenced them to\nundergo rigorous imprisonment for a period of three years and to pay a fine\nof\u00a0\u00a0 Rs. 4000\/\u00ad each and, in default of\npayment of fine, to further undergo rigorous imprisonment for a period of three\nmonths. The\u00a0\u00a0 trial\u00a0\u00a0 Judge, therefore, convicted\u00a0\u00a0 the appellant and his father and mother for\nthe offence punishable under Section 498\u00adA of the IPC and sentenced them to\nundergo rigorous imprisonment for a period of three years and to pay a fine\nof\u00a0\u00a0 Rs. 4000\/\u00ad each and, in default of\npayment of fine, to further undergo rigorous imprisonment for a period of three\nmonths.<\/p>\n\n\n\n<p><strong>Appeal made to the High Court:<\/strong><\/p>\n\n\n\n<p>High Court upheld the Conviction u\/s 498A of IPC. Additionally,\nHC sentenced appellant the imprisonment of five years and fine of Rs. 5000\/-\nunder Section 306 of IPC. Hence matter has been appealed to the Supreme Court.<\/p>\n\n\n\n<p><strong>Appellant\u2019s Contention:<\/strong><\/p>\n\n\n\n<p>High Court\u2019s confirmation to the sentence u\/s 498A is\nuntenable as conviction is solely on the basis of uncorroborated evidence of\none witness.<\/p>\n\n\n\n<p>High Court\u2019s sentence u\/s 306 is untenable as, charges were u\/s\n304-B; the ingredient of Section 304-B is totally different from that of Section\n306 of IPC.<\/p>\n\n\n\n<p>A\/c to the statement of the witness, appellant was in good\nterms with the father of deceased, which discredits his testimony.<\/p>\n\n\n\n<p><strong>Respondent\u2019s Contention:<\/strong><\/p>\n\n\n\n<p>Ingredient of Section 306 is similar to that of Section\n304-B and considering that Prosecution has proved his case; satisfying all the\ningredient of Section 306, Court\u2019s decision shouldn\u2019t be questioned. <\/p>\n\n\n\n<p><strong>Issue Raised:<\/strong><\/p>\n\n\n\n<p>Whether the conviction as confirmed by the High Court under\nSection 498\u00adA of the IPC and as recorded by it for the first time under Section\n306 of the IPC would be sustainable or not?<\/p>\n\n\n\n<p><strong>Held:<\/strong><\/p>\n\n\n\n<p>It is established that the woman concerned had committed\nsuicide within a period of seven years from the date of marriage and that her\nhusband has subjected her to cruelty, the court is not bound to presume that\nsuicide has been\u00a0\u00a0 abetted\u00a0\u00a0 by\u00a0\u00a0\nher\u00a0\u00a0 husband.\u00a0\u00a0 It\u00a0\u00a0\nis\u00a0\u00a0 required\u00a0\u00a0 to\u00a0\u00a0\ntake\u00a0\u00a0 into consideration all\nother circumstances of the case.<\/p>\n\n\n\n<p>Prosecution has failed to prove that the cruelty was of such\na nature which left no choice to the deceased than to commit suicide.<\/p>\n\n\n\n<p>Conviction\u00a0\u00a0 under\u00a0\u00a0 Section\u00a0\u00a0 498\u00adA\u00a0\u00a0 of\u00a0\u00a0 the\u00a0\u00a0 IPC\u00a0\u00a0 is maintained and the conviction under Section 306 of the IPC is set aside.
