Principles of natural justice have no application in case of compulsory retirement.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"FACTS\"><\/span><strong>FACTS<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul><li>There\nwas complaint against the appellant (i.e. Ram Murti Yadav Additional District\nand sessions Judge). The complaint was regarding an acquittal order granted by\nthe appellant when he was a Chief Judicial Magistrate. In response of the\ncomplaint an Administrative Judge recommended an enquiry on 24<sup>th<\/sup>\nFebruary 2009 not being satisfied with the comments of the appellant on the\ncomplaint against him. <\/li><li>A\nvigilance enquiry was held by an Officer on Special Duty, High Court of\nAllahabad. A censure entry<a href=\"#_ftn1\">[1]<\/a>\nwas recorded in the character roll of the appellant after the enquiry on 20<sup>th<\/sup>\nDecember 2012 and it was accepted by him without any challenge.\u00a0 <\/li><li>After\nthis the appellant was promoted to the post of Additional district and sessions\nJudge in 2013.<\/li><li>On\n1<sup>st<\/sup> April 2016 a committee of three judges constituted for screening\nof judicial officers for compulsory retirement<a href=\"#_ftn2\">[2]<\/a>\nunder the rules<a href=\"#_ftn3\">[3]<\/a>\nrecommended the compulsory retirement of the appellant. This recommendation was\nalso passed by the Full Court on 14<sup>th<\/sup> April 2016.<\/li><li>This\norder of the committee was challenged before the High Court on failure of which\nthis appeal was brought before the Apex court.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"ISSUE_OF_THE_CASE\"><\/span><strong>ISSUE OF THE CASE<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>Whether\nthe court can interfere in an order of compulsory retirement through Judicial\nReview?<\/li><li>Whether\nthe decision of the screening committee based on arbitrary or capricious\nground? <\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"WHAT_WAS_HELD\"><\/span><strong>WHAT WAS HELD?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ul><li>With\nregard to the first issue the court was of the opinion that the scope of\njudicial Review of an order of compulsory retirement based on the subjective\nsatisfaction of the employer is extremely narrow and only if its found to be\nbased on arbitrary or capricious grounds, vitiated by mala-fides, overlooks\nrelevant material, could there be limited scope for interference. It said<\/li><\/ul>\n\n\n\n<p><em>\u00a0\u201cThe court, in judicial review, cannot sit in\njudgement over the same as an Appellate Authority. Principles of natural\njustice have no application in case of compulsory retirement.\u201d<\/em><\/p>\n\n\n\n<ul><li>The\nCourt relied on the Judgement in <em>case\nSyed T.A Naqshbandi &#038;Ors vs. State of Jammu &#038;Kashmir &#038;Ors<\/em> <a href=\"#_ftn4\">[4]<\/a>.\nIt said that Judicial review is permissible only to the extent of finding\nwhether the process in reaching the decision has been observed correctly and\nnot the decision itself as such. <\/li><li>The\nCourt also cited the judgements in the cases of Rajendra Singh Verma vs. Lt.\nGovernor (NCT of Delhi)<a href=\"#_ftn5\">[5]<\/a>\nand High Court of Judicature at Bombay vs. Shashikant S. Ptil &#038; Anr<a href=\"#_ftn6\">[6]<\/a>.\u00a0 In which it was held that in such matter if a\nBona fide opinion is formed by the authority that the integrity of a particular\nofficer is doubtful then such opinion cannot be challenged before the court.\nThis is because when such the constitutional function is exercised by the\nadministrative side of the High Court, any Judicial review should be made with\ncircumspection and in parameter set by the courts in several reported\ndecisions. <\/li><li>By\nthis court is basically saying that in the matters of Judicial review of such\nscreening processes the court can only see if the process was conducted in a\njust manner, they cannot go into the questions relating to the correctness of\nthe decision taken by the process.<\/li><li>On\nthe second issue the court held that even a single adverse entry could suffice\nfor an order of compulsory retirement relying upon the judgement in the case of\n<em>Pyare Mohan Lal vs. State of Jharkhand\nand ors<\/em><a href=\"#_ftn7\">[7]<\/a>.\nIn this case the Apex court had spread clarity on the process of Screening in\nsuch matters, which involves a committee of Judges of the High Court duly\nconstituted by the Chief Justice of that High Court and then the report made by\nthis committee is placed before the Full Court which takes a decision after due\ndeliberation on this matter. Therefore there is hardly any chance to make the\nallegations of the non-application of mind or mala-fides.<\/li><\/ul>\n\n\n\n<p>\n\n\n\n\n\n\n\nThe Court rejected\nthe contention of the counsel from the appellant side that the Promotion given\nto appellate in 2013 shows the integrity and merit he has. It said that a\nperson discharging Judicial duty is not like any other service. There needs to\nbe complete trust of the litigants over such an officer and thus even a single\nstigma on his record cannot be taken lightly, even though he was promoted. In\nthis case the appellant never challenged the censure entry on his record.\n\n<br><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<p><a href=\"#_ftnref1\">[1]<\/a> A censure\nentry is awarded to an employee when he allegedly does something that is\nagainst the interest of the department though it is not too big. It\u2019s a\nrecorded in your character roll for future reference of various screening\ncommittees like in this case the committee for screening judicial officers for\ncompulsory retirement. <\/p>\n\n\n\n<p><a href=\"#_ftnref2\">[2]<\/a> This is a form of penalty given in cases where the government feels\nthe continuance of service of a Government servant is considered undesirable\nbut the extreme penalty of removal or dismissal, with the consequent loss of\npension, is considered to be too severe.\u00a0\n<\/p>\n\n\n\n<p><a href=\"#_ftnref3\">[3]<\/a> Rule 56(c)\nof the U.P.
