Sadhana Foundation Civil Appeal No. 9265\/2019<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"FACTS_OF_THE_CASE\"><\/span><strong>FACTS\nOF THE CASE:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>The\npresent appeal lies in respect of the recovery of the rent which was due to the\nlandlord-Respondent herein from the period of 01.11.2015 to 31.01.2017 which\nwas in reference to the registered lease deed dated 01.03.2015 (hereinafter\nreferred as \u2018registered lease deed\u2019), but the contention was raised relying on\nthe unregistered lease deed dated 01.01.2013 (hereinafter referred as\n\u2018unregistered lease deed\u2019), on account of which the previous recovery suit for\nthe duration of 01.01.2013 to 30.10.2015 was dismissed by all forums, including\nthe Hon\u2019ble Supreme Court of India. <\/li><li>The\ntenant-Appellant in the present case raised the arguments pointing out Clause\n1(c) of the lease deed which provided that, the Lessee\/ tenant was to carry out\nall the construction &amp; interior work in respect of the tenanted property\nand the approximate cost that would incur in such activity will be \u20b99,00,00,000\n(Rupees Nine Crores Only) could be adjusted against the rent due to the\nlandlord.<\/li><li>In\nrespect of the expenditure made by the Tenant, an account of approx.\n\u20b93,00,00,000 (Rupees Three Crores Only) was provided, which was to be adjusted\nagainst the total rent for the period of 15 months due to the landlord and rent\nfixed per the deed and which was provisionally fixed by the Rent\nController&nbsp; was same to be \u20b97,50,000\n(Rupees Seven Lakhs Fifty Thousand only) which was calculated to be recovered\nof approx. \u20b91,12,50,000 (Rupees One Crore Twelve Lakhs Fifty Thousand only). <\/li><li>Thus,\nthe amount of \u20b91,12,50,000 were to be adjusted against the expenditure made by\nthe Tenant and remaining amount was to be Paid by the Landlord, per the\ncontention raised by the Appellants in the present case. <\/li><li>But,\nthe Landlord-Respondent categorically denied the validity of the registered\nlease deed, as the Trustee who entered the unregistered lease deed Mr. Ajay\nSharma, was at the time of latter deed, removed and thus, was not governed by\nthe registered deed but was to be governed by the unregistered lease deed,\nwhich didn\u2019t carry the similar clause 1(c) as it was embodied in the registered\none. <\/li><\/ol>\n\n\n\n<p><em>Therefore, the Landlord was entitled to\nrecover the whole due amount without any adjustment and set-off. Thus, the\npresent appeal. <\/em><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"ISSUES_RAISED\"><\/span><strong>ISSUES\nRAISED<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>Whether the unregistered lease deed contents are admissible in evidence and the same is properly stamped or not will be of greater concern to quote its admissibility? <\/li><li>&nbsp;Whether the lease deed of 2013 or that of 2015 will govern the rights of the parties? <\/li><li>Whether Shri Ajay Sharma was a trustee and entitled to execute the lease deed of 2015? <\/li><li>Even if the lease deed of 2015 will govern the rights of the parties, what amount has been spent by the Appellant? <\/li><\/ol>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"RULING_OF_THE_COURT_THE_COURT_HELD_THAT\"><\/span><strong>RULING\nOF THE COURT\/ THE COURT HELD THAT:<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<ol><li>As\nall the material placed on record, for the purpose of ascertaining the amount\nspent by the Appellant, the same shall be of the subject matter of evidence and\nwill be evaluated on the touch stone of leading the evidences and cannot be\ndecided at this stage, which was not in the case of previous appeal for\nrecovery of rent between the same parties and same subject matter.<\/li><li>Following\nthe aforementioned reason, the present appeal was dismissed while giving the\nfollowing directions:<ol><li><em>The\ntenant shall be liable to pay rent @ \u20b93,75,000 w.e.f. 01.11.2015 till the\nproceedings before the Rent Controller is finally disposed and thereby landlord\nis not required to file any separate eviction petition for subsequent periods. <\/em><\/li><\/ol><ol><li><em>Tenant\nshall submit the rent @ \u20b93,75,000 w.e.f. 01.11.2015 till 30.11.2019, after\nadjusting his payment made before 31.01.2020. <\/em><\/li><\/ol><ol><li><em>Tenant\nshall furnish tangible security in sum of \u20b93,00,00,000 (Rupees Three Crores\nOnly), in case the Rent Controller decides against the Tenant Appellant. <\/em><\/li><\/ol><ol><li><em>Rent\nController is directed to take up this matter on urgent basis and dispose off\nthe same within 6 months from the date of this judgment. <\/em><\/li><\/ol><\/li><\/ol>\n","protected":false},"excerpt":{"rendered":"<p>Harshit Sharma | Amity Law School, Madhya Pradesh | 16th December 2019 Espire Infolabs Pvt Ltd. v\/s.
