Mehta School Of Law, NMIMS University, Mumbai | 23rd December\u00a02019 <\/strong><\/p>\n\n\n\n<p><strong>JHARKHAND PUBLIC SERVICE COMMISSION Vs MANOJ KUMAR GUPTA AND ANR. |<\/strong> CIVIL APPEAL NO. 9441 OF 2019.<\/p>\n\n\n\n<p><strong>Facts of Case:<\/strong><\/p>\n\n\n\n<p>The Jharkhand Public Service Commission (JPSC) issued an\nadvertisement on 19.07.06 inviting applications\u00a0\u00a0 from candidates desirous of competing in the\nJharkhand Eligibility Test (JET). This test is meant to determine the\neligibility of the candidates for appointment of lecturers in universities and\ncolleges in the state of Jharkhand. And is conducted as per the guidelines\nissued by the university grant commission (UGC).<\/p>\n\n\n\n<p>The test consists of three papers \u2013 the first two papers are\nmultiple choice questions to be answered on an Optical Mark Reader (OMR) out of\nwhich one is a general paper and the other one is of specific subject for which\nthe candidate has applied. And the third paper is of descriptive type questions\nbased on the selected subject by candidate.<\/p>\n\n\n\n<p>\u00a0Relevant portion of\nthe advertisement reads as follows:<\/p>\n\n\n\n<p>\u201cA candidate who does not appear in Paper\u00ad I will not be\npermitted to appear in Paper\u00ad II and Paper\u00ad III. Paper III will be evaluated\nonly for those candidates who are able to secure the minimum qualifying marks\nin paper I and II as per the table given below.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"\"><tbody><tr><td>\n<strong>\u00a0<\/strong>\n<strong>Category<\/strong>\n<\/td><td>\n<strong>Minimum Qualifying Marks<\/strong>\n<\/td><\/tr><tr><td>\n<strong>Paper 1<\/strong>\n<\/td><td>\n<strong>Paper 2<\/strong>\n<\/td><td>\n<strong>Paper 1 + Paper 2<\/strong>\n<\/td><\/tr><tr><td>\n<strong>General\/OBC<\/strong>\n<\/td><td>\n<strong>40<\/strong>\n<\/td><td>\n<strong>40<\/strong>\n<\/td><td>\n<strong>100 (50%)<\/strong>\n<\/td><\/tr><tr><td>\n<strong>PH\/VH<\/strong>\n<\/td><td>\n<strong>35<\/strong>\n<\/td><td>\n<strong>35<\/strong>\n<\/td><td>\n<strong>90 (45%)<\/strong>\n<\/td><\/tr><tr><td>\n<strong>SC\/ST<\/strong>\n<\/td><td>\n<strong>35<\/strong>\n<\/td><td>\n<strong>35<\/strong>\n<\/td><td>\n<strong>80 (40%)<\/strong>\n<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Manoj<strong> <\/strong>obtained50%\nmarks in Papers I and II but he did not do as well in Paper III.\u00a0 The JPSC fixed a cut off percentage of 60 for\nPaper III which the writ petitioner did not.attain and as such he was declared\nnot successful and, therefore, ineligible to be considered for appointment as\nlecturer.<\/p>\n\n\n\n<p>Aggrieved by the said action, the writ petitioner filed a\nwrit petition before the High Court which allowed the same.The appeal filed by\nthe JPSC before the writ court was also allowed mainly on the ground that the\nPublic Service Commission could not have fixed qualifying marks of 60% and this\namounted to changing the rules of the game after the advertisement had been\nissued and process of selection had started.\u00a0\nIt held that once the candidate had obtained 50% marks, the candidate\ncould not be disqualified and the JPSC was not bound by the instructions of the\nUGC in this regard.The High Court also directed that the case of the writ\npetitioner would be considered on the basis of performance.The High Court held\nthat no cut off marks had been provided for Paper III.<\/p>\n\n\n\n<p>The scheme framed by the UGC has a provision for\nconstitution\u00a0\u00a0 of\u00a0\u00a0 a\u00a0\u00a0\nmoderation\u00a0\u00a0 committee\u00a0\u00a0 which\u00a0\u00a0\nwill\u00a0\u00a0 help\u00a0\u00a0 in deciding\u00a0\u00a0\nthe\u00a0\u00a0 cut\u00a0\u00a0 off\u00a0\u00a0\nmarks\u00a0\u00a0 in\u00a0\u00a0 each\u00a0\u00a0\nsubject\u00a0\u00a0 for\u00a0\u00a0 declaring\u00a0\u00a0\nthe result.<\/p>\n\n\n\n<p>JPSE said that\u00a0\u00a0\nthe\u00a0\u00a0 moderation\u00a0\u00a0 committee, keeping in view the various\nfactors, decides what should be the cut off\u00a0\nmarks in\u00a0 each subject and\u00a0 this\u00a0\ndoes not\u00a0 have\u00a0 to\u00a0 be\ndecided at the stage of issuance of advertisement. The advertisement does not 4\nenvisage any minimum cut\u00adoff marks for Paper III. Both sides have challenged\nthe judgment of the High Court and we are deciding both the appeals by this\ncommon judgment.<\/p>\n\n\n\n<p><strong>HELD:<\/strong><\/p>\n\n\n\n<p>The Supreme Court said that, Clause 4 of the scheme clearly\nstates that\u00a0 the\u00a0\u00a0 moderation\u00a0\u00a0\ncommittee\u00a0\u00a0 has\u00a0\u00a0 been\u00a0\u00a0\nconstituted\u00a0\u00a0 only\u00a0\u00a0 for\u00a0\u00a0\nthe purpose\u00a0\u00a0 of\u00a0\u00a0 deciding\u00a0\u00a0\nthe\u00a0\u00a0 cut\u00adoff\u00a0\u00a0 marks\u00a0\u00a0\nin\u00a0\u00a0 each\u00a0\u00a0 subject\u00a0\u00a0\nfor declaring the result.\u00a0 The\nadvertisement clearly indicates that only those candidates who obtained 50%(for\ngeneral\/OBC) marks in Paper I and II would be eligible to take the test in\nPaper III.<\/p>\n\n\n\n<p>That\u00a0\u00a0 need\u00a0\u00a0 will\u00a0\u00a0\narise\u00a0\u00a0 only\u00a0\u00a0 when\u00a0\u00a0\nthe\u00a0\u00a0 moderation committee\u00a0\u00a0 meets\u00a0\u00a0\nand\u00a0\u00a0 decides\u00a0\u00a0 what\u00a0\u00a0\nshould\u00a0\u00a0 be\u00a0\u00a0 the\u00a0\u00a0\nlevel\u00a0\u00a0 of competence expected\nfrom the people who are to be considered for appointment as Lecturers.It is for\nthe moderation committee to decide what should be the cut\u00adoff marks.<\/p>\n\n\n\n<p>There could be the subject where all the people who\nqualified Paper I and II get very low marks in Paper III and the moderation\ncommittee may be justified\u00a0\u00a0 in\u00a0 prescribing\u00a0\u00a0\nlower qualifying standards.\u00a0 On\nthe other hand, there may be a subject where\u00a0\u00a0\nthere\u00a0\u00a0 are\u00a0\u00a0 many\u00a0\u00a0\ncandidates\u00a0\u00a0 who\u00a0\u00a0 do\u00a0\u00a0\nextremely\u00a0\u00a0 well\u00a0\u00a0 in Paper\u00a0\u00a0\nIII\u00a0\u00a0 and\u00a0\u00a0 the\u00a0\u00a0\nmoderation\u00a0\u00a0 committee\u00a0\u00a0 may\u00a0\u00a0\ndecide\u00a0\u00a0 to\u00a0\u00a0 fix\u00a0\u00a0\na higher standard. The constitution of a moderation committee is\nnormally done only to do this sort of moderation. <\/p>\n\n\n\n<p>The High Court erred in holding that the JPSC could not fix the minimum marks for Paper III.\u00a0 Hence, we set aside the judgment of the High Court dated 09.11.2016.\u00a0 The Civil Appeal No. 9441 6 of 2019 filed by the Jharkhand Public Service Commission is allowed and Civil.Appeal.
