{"id":420,"date":"2020-04-23T10:29:52","date_gmt":"2020-04-23T10:29:52","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=420"},"modified":"2021-01-17T04:35:38","modified_gmt":"2021-01-17T04:35:38","slug":"for-grant-of-temporary-injunction-the-party-filing-it-must-make-out-a-prima-facie-case","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/for-grant-of-temporary-injunction-the-party-filing-it-must-make-out-a-prima-facie-case\/","title":{"rendered":"The party filing for grant of temporary injunction, must make out a Prima Facie case"},"content":{"rendered":"\n<p><strong> Lahari Gurrala | Symbiosis Law School, Hyderabad | 26th December 2019\u00a0 <\/strong><\/p>\n\n\n\n<pre class=\"wp-block-preformatted\"> <strong>Saketa Vaksana LLP & Anr\u2026\u2026\u2026(Appellants)<\/strong>\n<strong>\u00a0vs <\/strong>\n<strong>Kaukutla Sarala & Ors\u2026\u2026(Respondents)<\/strong>\nCIVIL APPEAL NO. 9483 OF 2019 <\/pre>\n\n\n\n<p><strong>Facts of Case:<\/strong><\/p>\n\n\n\n<ul><li>the Appellant \u2013 Developer and the Respondent \u2013\nLandowners entered into an Agreement of Sale dated 17.11.2017, whereby the\nRespondents agreed to sell agricultural land comprising of 54 acres 13 guntas\nsituated in Turkapalli Village, Shamirpet Mandal, Medchal\u00ad Malkajgiri District\nto the Appellant \u2013 Developer. The sale consideration was fixed at Rs.\n46,00,000\/\u00ad per acre. <\/li><li>The land was divided into 5 schedules, and each\nschedule of land was to be sold to the Appellant \u2013 Developer upon payment of\nthe proportionate sale consideration. Clause 7 of the Agreement dated\n17.11.2017 stated that physical possession of the entire land was handed over\nto the Appellant \u2013 Developer on the day of execution of the Agreement.<\/li><li>The Agreement of Sale dated 17.11.2017 was an\nunregistered document executed on a Stamp Paper of Rs. 100. The Stamp Duty on\nthis Agreement was paid by the Appellant \u2013 Developer on 27.08.2018 <\/li><li>Out of the total extent of\nland, the Respondents executed four registered Agreements of Sale cum\nGeneral Power of Attorney with respect to 36 acres 211\u20442 guntas of land in\nfavour of the Appellant \u2013 Developer. The first two Agreements of Sale were\nexecuted on 03.01.2018; the third on 24.03.2018; and the fourth on\n31.03.2018. <\/li><li>The Appellant \u2013 Developer submitted that it has\npaid Rs. 17,25,00,000\/\u00ad for the aforesaid four Agreements of Sale. The\nRespondents have seriously disputed this submission, and stated that an amount\nof only Rs. 14,25,00,000\/\u00ad was paid by the Appellant \u2013 Developer. This gave\nrise to disputes between the parties for payment of the balance consideration\nfor land admeasuring 17 acres 31 1\/2 guntas (\u201csuit property\u201d). <\/li><\/ul>\n\n\n\n<ul><li>The Appellant\n\u2013 Developer filed a Suit for Specific Performance seeking Specific Performance\nof the Agreement of Sale dated 17.11.2017 before the XVI Additional District\nand Sessions Judge, Ranga Reddy District (\u201cTrial Court\u201d). <\/li><li>The Appellant\/Plaintiff prayed that the\nRespondents be directed to execute the Sale Deed for the suit property\nadmeasuring 17 acres 311\u20442 guntas; and provide ingress and egress to the land\nadmeasuring 36 acres 211\u20442 guntas for which the registered Agreements of Sale\ncum GPA had been executed. <\/li><li>The Appellant \u2013 Developer filed two I.A.s in\nthe Suit praying for Temporary Injunction under Order XXXIX Rule 1 and 2 of the\nCPC before the Trial Court.\u00a0 First I.A\nwas filed for a temporary injunction restraining the Respondents from\ninterfering with the peaceful possession and enjoyment of the Appellant\n\u2013Developer over the entire land admeasuring 54 acres 13 guntas. <\/li><li>Second I.A was filed for a temporary injunction\nrestraining the Respondents from alienating or creating any third-party\ninterest in the suit property admeasuring 17 acres 31 1\u20442 guntas.\u00a0 <\/li><li>The Trial Court passed\nan Interim Order dated 01.05.2019 in first I.A. with respect to the prayer for\ninjunction restraining the Respondents from interfering with the peaceful\npossession of the Appellant \u2013 Developer over the suit property, and held that\nthe issue with respect to possession of the suit property admeasuring 17 acres\n31 1\u20442 could only be decided in trial.<\/li><li>In view of the aforesaid facts, the Trial\nCourt held that the Appellant \u2013 Developer made out a <em>prima facie <\/em>case,\nand the balance of convenience was in their favour. The Trial Court granted a\ntemporary injunction restraining the Respondents from interfering with the\npossession of the Appellant \u2013 Developer over the suit property excluding the\nextent of 12,000 sq. feet. till the\ndisposal of the suit, subject to the Appellant \u2013 Developer depositing the\nbalance sale consideration @Rs. 46,00,000\/\u00ad per acre. <\/li><li>Later on the, the appellant-\nDevelopers field two Miscellaneous Appeals before a Single Judge of the High Court to\nchallenge the Interim Orders passed by the Trial Court. The Respondents filed a\ncross Miscellaneous Appeal before the division bench of the High Court praying\nfor setting aside the Temporary Injunction restraining them from interfering\nwith the peaceful possession of the Appellant- Developer over the suit\nproperty.<\/li><\/ul>\n\n\n\n<ul><li>It is relevant to\nnote that the Order dated 01.05.2019 passed by the Trial Court in second\nI.A has not been challenged by the Respondent \u2013 Landowners. <\/li><li>A Single Judge of the High Court <em>vide <\/em>Interim\nOrder, directed that the Temporary Injunction restraining the Respondents\nfrom interfering with the peaceful possession of the Appellant \u2013 Developer\nwould extend to the entire suit property, including the parcel of 12,000\nsq. feet of land and that the injunction\nrestraining the Respondents from creating third party rights in the suit\nproperty would operate, without the condition of depositing the balance sale consideration.<\/li><li>In C.M.A. filed by\nthe respondents, the division bench of the High Court <em>vide <\/em>order dated\n14.08.2019, the impugned Interim Orders, has set aside the Order of Temporary\nInjunction dated 01.05.2019 passed by the Trial Court in the first I.A. <\/li><li>As the appellants were dissatisfied\nby the interim orders passed by the High Court, they challenged it in the\nSupreme Court in the way of Civil Appeal.<\/li><\/ul>\n\n\n\n<p><strong>Issues:<\/strong><\/p>\n\n\n\n<ul><li>Whether possession\nof the suit property was at all handed over to the Appellant \u2013 Developer or not?<\/li><li>whether\npart consideration for the suit property was paid by the Appellant \u2013\nDeveloper to the Respondent \u2013 Landowners or not?<\/li><\/ul>\n\n\n\n<p><strong>Held:<\/strong><\/p>\n\n\n\n<ul><li>The court held that\nthe orders dated 14.08.2019 passes by the division bench of the High Court do\nnot warrant any interference. The High Court has already granted a Temporary\nInjunction restraining the Respondents from alienating or creating third party rights\nin the suit property till the disposal of the Suit. The interest of the\nAppellant \u2013 Developer has been sufficiently protected with respect to ownership\nof the suit property. <\/li><li>It was also held that the Orders dated\n14.08.2019 passed by the division bench of High Court, whereby the Temporary\nInjunction restraining the Respondents from interfering with the possession of\nthe Appellant \u2013 Developer over the suit property has been vacated. <\/li><li>The court expressed no opinion on the merits of\nthe matter, since the observations have been made at an interim stage of the\nproceedings. <\/li><li>Lastly, the court has directed that the hearing\nof O.S. No. 213\/2018 pending before the XVI Additional District and Sessions\nJudge, Ranga Reddy District be expedited, and disposed of preferably within a\nperiod of one year from today. <\/li><\/ul>\n\n\n\n<p>\n\n\n\n\n\n\n\nThe Civil Appeals are\ntherefore, dismissed.
