Versus State of Rajasthan CRIMINAL APPEAL NO. 1779 OF 2019<\/strong><\/p>\n\n\n\n<p><strong>Facts <\/strong>\u2013\u00a0<\/p>\n\n\n\n<p>\u00a0On 22.5.2005 at 9.30 P.M, 14\npersons namely Jodhraj, Hemraj, Bhanwar Lal, Mathura Lal, Dwarka Lal, Dev\nKishan, Om Prakash, Naval Kishore, Birdhi Lal, Badri Lal, Ram Prasad, Prabhu\nLal, Ram Dayal and Pooran Mal constituted unlawful assembly in the revenue estate\nof village Kadiayavan and caused injuries to Hariram due to which he died the\nintervening night of 22nd May and 23rd May of 2005.<\/p>\n\n\n\n<p>The learned counsel on the behalf of the\nstate examined 18 eye\u00adwitnesses in this case . Injury report was also brought\nforward of the deceased by the learned counsel &#8211;<\/p>\n\n\n\n<p>(i) abrasion 1 cm X 1 cm, on the right\nside of the forehead<\/p>\n\n\n\n<p>(ii) Incised wound, 7 cm X 1cm, on the\nright side of the neck<\/p>\n\n\n\n<p>(iii) Incised wound, 20cm X 7 cm,\nintestine coming out on anterior on abdomen and intestine coming which is\ngrievous and dangerous to life<\/p>\n\n\n\n<p>The learned Trial Court upon the\nsubmission of the shreds of evidence convicted five people accused of the\noffences u\/s\u00a0<a href=\"https:\/\/indiankanoon.org\/doc\/763672\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sections 148<\/a>,\u00a0<a href=\"https:\/\/indiankanoon.org\/doc\/1560742\/\" target=\"_blank\" rel=\"noreferrer noopener\">302<\/a>\/<a href=\"https:\/\/indiankanoon.org\/doc\/999134\/\" target=\"_blank\" rel=\"noreferrer noopener\">149<\/a>\u00a0and\u00a0<a href=\"https:\/\/indiankanoon.org\/doc\/1101188\/\" target=\"_blank\" rel=\"noreferrer noopener\">379<\/a>\u00a0of IPC, who were Jodhraj, Bhanwar\nLal, Dwarka Lal, Jagdish Prasad, Pooran Mal and gave the benefit of doubt by\nacquitting the rest of the accused<\/p>\n\n\n\n<p>The convicted appealed before the High\nCourt and the state appealed against the order of acquittal of the accused.<\/p>\n\n\n\n<p>The high court acquitted Bhanwar Lal\ngiving him benefit of doubt and confirmed the conviction of Jodhraj and Jagdish\nPrasad relying upon the deposition of PW2 and PW3, where the court disbelieving\ntheir statement in the case of Bhanwar Lal.<\/p>\n\n\n\n<p>The learned counsel appearing on the\nbehalf of convicts stated that High court has convicted the accused solely\nrelying on the evidence given by PW2 and PW3 and they were represented beyond\nthe truths. The statements made by these eyewitnesses should not be taken into\nconsideration as Bhanwar Lal and others were acquitted by not believing the\ndeposition of PW2 and PW3, the same should apply to appellants also. In the\ntrial, no other evidence was considered.<\/p>\n\n\n\n<p><strong>Issue \u2013<\/strong><\/p>\n\n\n\n<p><em>Whether deposition of eyewitness not relied in the case of one of the\naccused and acquitting him giving benefit of doubt should be considered the\nsame as the other accused also.<\/em><\/p>\n\n\n\n<p><strong>Judgement \u2013\u00a0<\/strong><\/p>\n\n\n\n<p>\u00a0 The statements made by eyewitnesses pw2and\npw3 were recorded after 18 days and due to this time gap, both the witnesses\ntook undue advantage of the delay and gave an exaggerated deposition. <\/p>\n\n\n\n<p>High court\nacquitted\u00a0 Bhanwar Lal not relying on the\ndeposition of PW2 and PW3 whereas confirming the conviction of Jodhraj and\nJagdish believing the same witnesses.<\/p>\n\n\n\n<p>Therefore, it was held\nthat if the deposition of eyewitnesses is not reliable qua one of the accused,\ncame to be acquitted by giving benefit of doubt, the same benefit ought to have\nbeen given to the other accused also, unless there is some further\nmaterial\/evidence against the other accused. <\/p>\n\n\n\n<p>In this case, no other\nevidence is implicating the accused except relying upon the deposition of PW2\nand PW3, thus the appeal preferred by accused Jodhraj and Jadish Prasad is\nhereby allowed and the appeal of Bhanwar Lal preferred by the state is\ndismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Shubhani Mittal | Vivekananda Global University | 28th December 2019 Jodhraj &#038; Anr.
