After the\nexpiration of these 12 years the original owner is remediless and thus the\nperson in possession gains a negative title over the property. <\/li><li>In\nother words if a person is in possession of someone else\u2019s property and such\npossession continues peacefully without any interruptions or attempts from the\nowner in 12 years\u00a0 to regain his\npossession the title for the property will shift to the person in possession of\nthe property for that period. This shifting of title is due to the inaction by\nthe original owner.<\/li><li>Although\nin case the original owner is a minor, or of unsound mind or is serving in the\narmed forces then adverse possession cannot take place. And in case the land is\na government property then the limitation period for a suit for possession is\n30 years as per Article 112 of the act.<\/li><li>Through\na plethora of Judgements the Apex court has clarified this archaic law to a\ngreat extent. In one such case named <em>Gurudwara\nSahab v. Gram Panchyat Village Sirthala<\/em><a href=\"#_ftn1\">[1]<\/a>the Court gave a ruling that the plea\nof adverse possession can only be used as a defence when a suit for dispossession\nis filed by the true owner against the person in possession of the land. In\nother words a person cannot bring a suit under Article 65 of the act for\ndeclaration of title and for a permanent injunction seeking protection of his\npossession on the basis of a title through adverse possession. He\/she can only\nuse it as a defence in case a suit is filed against them for dispossession.<\/li><\/ul>\n\n\n\n<p><strong>Issues\nconsidered<\/strong><\/p>\n\n\n\n<ul><li>Whether\na person claiming the title by virtue of adverse possession can maintain a suit\nunder Article 65 of the act for declaration\u00a0\nof title and for a permanent injunction seeking the protection of his\npossession thereby restraining the defendant from interfering in possession or\nfor restoration of possession in case of illegal dispossession by a defendant\nwhose title has been extinguished by virtue of the plaintiff remaining in the\nadverse possession or in case of dispossession by some other person?<\/li><\/ul>\n\n\n\n<p><strong>What\nwas held?<\/strong><\/p>\n\n\n\n<ul><li>The\nApex Court after discussing a good number of Judgements came to the conclusion\nthat the act does not bar a person from filing a suit for possession on the\nbasis of a title through adverse possession.<\/li><li>The\ncourt observed that the statute (Limitation Act) does not define adverse\npossession but merely prescribes a limitation period of 12 years for filing a\nsuit for possession under Article 65 and extinguishment of right after such\nperiod. There may be a case where a person who has perfected his title through\nadverse possession is sought to be ousted or has been dispossessed by a\nforceful entry by the owner, his right to obtain possession can be resisted\nonly when the person who is seeking to protect his possession, is able to show\nthat he has also perfected his title by adverse possession for requisite period\nagainst such plaintiff. The Court discussed various judgements in which the\nsame has been reiterated.<\/li><li>In\nthe case of <em>Pannalal Bhagirath Marwadi v.\nBhaiyalal Bindraban Pardeshi Teli<\/em><a href=\"#_ftn2\">[2]<\/a>it was observed that a person in\npossession cannot be dispossessed otherwise than in due course of law and can\nsue for protecting the possession. The Court in <em>Somanth Burman v. S.P. Raju<\/em><a href=\"#_ftn3\">[3]<\/a>\nsaid that right to sue is available to the plaintiff against owner as well as\nother by taking the plea of adverse possession in the plaint.<\/li><li>The\nCourt while discussing the Judgement in <em>Gurudwara\nSahib case <\/em>observed that the ruling cannot be held as correct law because\nnone of the important judgements related to adverse possession were put before\nthe court, this was because adverse possession was not pleaded by the plaintiff\nand thus the court just made an observation on the basis of a Punjab and\nHaryana High Court Judgement in the case of <em>Gurdwara\nSahib\u00a0Sannauli\u00a0v.\u00a0State\u00a0of\u00a0Punjab<a href=\"#_ftn4\"><strong>[4]<\/strong><\/a>.<\/em><strong><\/strong><\/li><li>Another Judgment that has\nbeen cited in <em>Gurudwara Sahib<\/em> is Bhim\nSingh and Ors. v. Zile Singh and Ors<a href=\"#_ftn5\">[5]<\/a>\nmade an observation that Language used in IIIrd Column of Article 65 of the act\nmakes it clear that the plea can only be used as a defense. The sentence in\nIIIrd column is \u201cthe limitation of 12 years runs from the date when the\npossession of the defendant becomes adverse to the plaintiff\u201d. The use of word\n\u201cdefendant\u201d is what the conclusion is being based here.
