He then\ndrove the children away and picked up the appellant from his house <\/p>\n\n\n\n<p>The\nchildren were taken to a distant place called Gopalsamy Temple Hills on the\nsame day where ghastly rape was allegedly committed on that girl.<\/p>\n\n\n\n<p>In\norder to get rid of the children, Mohanakrishnan and the appellant mixed a\npoisonous cow dung powder which is added in the cow dung to keep the insects\naway with mild and administered to the children.<\/p>\n\n\n\n<p>However,\nthe children took only a small amount of milk which was mixed with cow dunk\npowder and didn\u2019t die.<\/p>\n\n\n\n<p>Thereafter,\nto get rid of the children, they were thrown away alive in Parambikulam-Axhiyar\nProject canal (\u201cPAP Canal\u201d). Mohanakrishnan went to the house of PW7 from whom\nhe borrowed Maruti Omni Van, informed the police, pursuant to which he was\narrested.<\/p>\n\n\n\n<p>The\ngirl\u2019s body was recovered from the canal. The Appellant was arrested and the\nboy\u2019s body was also recovered from the canal. Mohankrishnan was shot dead by\nthe police in an encounter and Manoharan was convicted of death penalty.<\/p>\n\n\n\n<p><strong>Issue <\/strong><\/p>\n\n\n\n<p>Whether\u00a0 death penalty can be awarded even if one of\nthe judges disagree ?<\/p>\n\n\n\n<p><strong>Judgement<\/strong> <\/p>\n\n\n\n<p>The\n\u00a0review petition was brought to the Supreme Court of India before the\ndivision bench comprising of Justice Rohinton Fali Nariman, Justice Sanjiu\nKhanna, and Justice Surya Kant. The order was passed in the majority of 2:1.<\/p>\n\n\n\n<p>The majority view has prevailed that upholded\nconviction and death penalty while dismissing the review petitions. The \u00a0senior advocate Siddharth Luthra argued \u00a0that death penalty ought not to be awarded in\ncase of a single dissent, even if the majority sanctioned it. It was purported that\nthe offence committed by the petitioner was so grave so as to shock the\nconscience of the court and of society and would without doubt amount to\n&#8216;rarest of the rare&#8217;.
