She was issued an admit card in the first week of July, 2019. The\nexamination was held on 21.07.2019 and the result was declared on 16.08.2019. <strong><\/strong><\/li><li>At\nthe time of appearing in the examination, it was however pointed-out to the\npetitioner that instead of filling her name in the application form, she filled\nthe name of her mother. The petitioner made a representation for correction of\nthe name on 20.08.2019; but by an order dated 09.09.2019, the respondent\nrefused to accede to her request, which led to the filing of the OA, before the\nCentral Administrative\nTribunal (the \u2018Tribunal\u2019), which stands dismissed.<strong><\/strong><\/li><li>Aggrieved\nby the judgment passed by the Tribunal the petitioner has filed a Writ Petition\nin the High Court of Delhi.<strong><\/strong><\/li><li>The\nlearned counsel for the petitioner has submitted and placed reliance on the\nguidelines for filing-up the online Detailed Application Form (DAF), more\nparticularly para 11 of the DAF which provides for correction of errors in\nfilling-up of the form and reads as under: <strong><\/strong><\/li><\/ul>\n\n\n\n<p>\u201cCandidates may note that some of the fields namely Candidate\u2019 s name,\nDate of Birth, Father\u2019 s name, Mother\u2019s name, email address, Physically Challenged category, Disability\npercentage etc. have been prepopulated using the information provided by the\ncandidate at the time of filling up the earlier Online Application Form for\nwriting the Written Examination\/Preliminary Written Examination. Such fields\ncannot be changed by the candidate. However, if a Candidate notes any\nerror\/discrepancy in these fields, he may make a separate detailed\nrepresentation to the Commission including all relevant documents, in support\nof his claim. The Commission will decide each such case on merit and its\ndecision in such cases shall be final.\u201d<\/p>\n\n\n\n<ul><li>Further it was also submitted that the petitioner\u2019s case\ncannot be equated with a case of wilful and <em>mala fide <\/em>default, with\nintention of providing false information or documents; and that it was a case\nof genuine and inadvertent error ; and the consequences are not commensurate\nwith the error which has been committed by her. <\/li><li>Learned counsel\nof the respondents have submitted that in a matter like this, this Court and\nthe Supreme Court have not allowed such relief having regard to the fact that\nthe Union Public Service Commission (UPSC), which conducts several nationwide\nexaminations, receives a large number of applications every year; and if such\nlaxity is allowed or condoned, it will be virtually impossible for the UPSC to\nmeet deadlines and compile the details which are required to be sent to user\ndepartments. <\/li><\/ul>\n\n\n\n<p><strong>Issue:<\/strong><\/p>\n\n\n\n<ul><li>Whether , in the facts of the present case, the\npetitioner should be allowed to correct a <em>bona fide <\/em>error in the application\nform?<\/li><\/ul>\n\n\n\n<p><strong>Held:<\/strong><\/p>\n\n\n\n<ul><li>The\nCourt has found force in the submission of the learned counsel for the\npetitioner that this case cannot be equated with a case of wilful or <em>mala\nfide <\/em>attempt at providing false information or false\/fabricated documents ;\nor a case where a candidate intends to mislead the respondent in any manner. No\ndoubt the respondent receives a very large number of applications ; and it\ncannot possibly be making corrections in such applications, but a reading of\npara 11 of the DAF shows that a provision has been made even for change of name\nin the application form, amongst other things. <strong><\/strong><\/li><\/ul>\n\n\n\n<ul><li>It\nwas stated that the fields mentioned in Para 11 of the DAF cannot be\nchanged by the candidate ; however a provision has been made that if a\ncandidate notes any error\/discrepancy in these fields, they may take\nrecourse by making a separate, detailed representation before the\nCommission, including all relevant documents in support of his or her\nclaim. <\/li><li>While the representation was\nmade by the petitioner and stands rejected, the court was of the\nview that the interpretation of para 11 of DAF adopted by the respondent\nis narrow and over-restrictive since the error committed by the petitioner\nis clearly unintentional and <em>bona fide<\/em>. It was also stated that,\nthe error committed by the petitioner, though fundamental, is not informed\nwith any malice, mala fides or sinister reason. It was also noted that,\nfrom the record annexed to the petition, the identity of the petitioner is\nverifiable and not in doubt. It is also seen that the respondent has\nissued the admit card with the petitioner\u2019s photograph, though with the\nmother\u2019s name. <\/li><li>Accordingly, the court is disposed\nto exercising its extraordinary jurisdiction under Article 226 of the\nConstitution of India in the petitioner\u2019s favour, since it considered this\nto be a deserving case where the candidature of the petitioner ought not\nto have been rejected by reason of an innocent and inadvertent error\ncommitted by her. While so opining, the court also conscious that by way\nof this order, the petitioner would only be able to participate in the\ninterview ; and whether or not she ultimately succeeds will be known in\nthe normal and usual course. It was made clear that this order is not\nintended to be used as a precedent. <\/li><li>In\nthe above view of the matter, the writ petition is allowed subject to\ncosts of Rs.5,000\/- to be deposited by the petitioner within two weeks\nwith the High Court of Delhi (Middle Income Group) Legal Aid Society. The\nimpugned order passed by the Tribunal is set-aside. The court has directed\nthe UPSC to carry-out the necessary correction in the petitioner\u2019s\napplication form. Consequently, the petitioner will be allowed to\nparticipate in the ensuing interview. <\/li><li>The writ petition stands disposed\nof.
