Ltd. Vs. The District Collector, WP No. 31230 of 2019<\/strong><\/p>\n\n\n\n<p>FACTS:<\/p>\n\n\n\n<ul><li>The\npetitioner in this case was running a service apartment in Coimbatore, Tamil\nNadu. A search was conducted in the premises by a team from the office of the\nTahsildar, Peelamedu Police Station. During the course of such search, it is\nstated that certain liquor bottles were found inside one of the rooms occupied\nby the guests and in one room two adults, male and female, who were not married\nwith each other were staying. The premises came to be sealed by the Team\nwithout any written order which has prompted the petitioner to file the present\nWrit Petition. <\/li><\/ul>\n\n\n\n<p>PETITIONER\nCONTENTION:<\/p>\n\n\n\n<ul><li>There\nwas no justification on the part of the respondents in not giving them an\nopportunity to put forth their objections and sealing of the premises without\nany order being served on them. It is violation of the Principles of natural\njustice. <\/li><li>They\nhad not served or sold liquors in the premises and if there was any liquor\nbottles in the rooms of the guests, such bottles could have been brought by the\nguests themselves, to which, the petitioner cannot have a check over the\nsame.\u00a0 <\/li><\/ul>\n\n\n\n<p>RESPONDENT\nCONTENTION:<\/p>\n\n\n\n<ul><li>The\nlearned Additional Public Prosecutor submitted that the petitioner&#8217;s premises\nhad not obtained \u2018Form D\u2019 of the Revenue Department.The details of the guests\nis not written in the Booking Registers and they are permitting illegal\nactivities by the guests. In view of the objections from the neighboring\nwomenfolk, action has been requested to be taken against the petitioner. <\/li><\/ul>\n\n\n\n<p>HELD:<\/p>\n\n\n\n<ul><li>Apparently,\nthere are no laws or regulations forbearing unmarried persons of opposite sex\nto occupy hotel rooms, as guests. While live-in-relationship of two adults is\nnot deemed to be an offence. While that being so, the extreme step of sealing\nthe premises on the ground that an unmarried couple were occupying the\npremises, is totally illegal in the absence of any law prohibiting the same.<\/li><\/ul>\n\n\n\n<ul><li>As\nUnder, The Tamil Nadu Liquor (Possession for Personal Consumption) Rules,\n1996,(hereafter referred as Act) permits any individual person to possess\nvarious types of liquor in specified quantities. Rule (2) of the Act prohibits\npossession of the following liquors for personal consumption, over and above\nthe quantity extracted hereunder: <\/li><\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"\"><tbody><tr><td>\n<strong>S.No. <\/strong>\n<\/td><td>\n<strong><em>Liquor (1) <\/em><\/strong>\n<\/td><td>\n<strong><em>Quantity (in Litres) (2) <\/em><\/strong>\n<\/td><\/tr><tr><td>\n1\n<\/td><td>\nIndian made Foreign\nSpirits\n<\/td><td>\n4.5\n<\/td><\/tr><tr><td>\n2\n<\/td><td>\nForeign Liquor\n<\/td><td>\n4.5\n<\/td><\/tr><tr><td>\n3\n<\/td><td>\nBeer\n<\/td><td>\n7.8\n<\/td><\/tr><tr><td>\n4\n<\/td><td>\nWine\n<\/td><td>\n9.0\n<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>The above\nrestriction thereby entitles a person to hold possession of the aforesaid four\ncategories of liquors to the quantities mention therein, within the State\nof Tamil Nadu.<\/p>\n\n\n\n<p>The consumption of\nliquor by the guests in the petitioner premises cannot also be termed as\nillegal. <\/p>\n\n\n\n<ul><li>Assuming\nthat such lacuna were discovered by the authorities, these can only termed as\ninfirmities, which required to be addressed by calling for explanation from the\npetitioner and thereafter take further course of action, thereby adhering to\nthe principles of natural justice.<\/li><li>Since\nthe entire action of sealing the petitioner\u2019s hotel without following the\nprinciples of natural justice is illegal.<\/li><li>The\nWrit Petition stands allowed.
