Pallavi Sharma, Crl Revision Petition No. 751 of 2018<\/strong><\/p>\n\n\n\n<p><strong>Facts &#8211;<\/strong><\/p>\n\n\n\n<p>Justice Manoj Kumar Ohri dismissed a revision petition which challenged\nthe order of the Family Court whereby it directed the petitioner husband to pay\nRs. 33,005 every month as \u00a0interim maintenance\nof the wife-respondent and their minor child.<\/p>\n\n\n\n<p>This above order was made by a magistrate while reviewing the\napplication the application under the provisions of Section 125 CrPC resorted\nto by the respondent wherein she alleged that she was thrown out of the\nmatrimonial home and thus was living with her mother at her parental home along\nwith her minor child. The respondent claimed that since she was not a working\nwoman, she didn\u2019t had any\u00a0 source of income and thus claimed Rs.80,000\/-\nper month as maintenance.<\/p>\n\n\n\n<p>The\u00a0 wife-respondent\nfurther stated\u00a0 that she has completed\nLLB and was enrolled as an advocate. She used to practice \u00a0prior to her\nmarriage and was pursuing her LLM but couldn\u2019t pursue her profession because of\nthe young age of her .<\/p>\n\n\n\n<p>The husband- petitioner submitted that he was working as an\nExecutive Chef in Convention Hotels Pvt. Ltd., Goa and earned about Rs.88,000\/-\nper month. He was looking after his old parents and had other liabilities\ntowards loan and rent.\u00a0\u00a0He was paying Rs.4,000\/- per month as\nmaintenance for the minor child.<\/p>\n\n\n\n<p>After calculating the net income of the husband, the court\nawarded \u00a0interim maintenance of\u00a0Rs.33,005\/- per month for\nwife-respondent and the minor child.<\/p>\n\n\n\n<p>Learned counsel for the husband- petitioner referred to the\nbio data of the wife and submitted that she was professionally qualified, an\nLL.B graduate, and had a sufficient income to look after herself.<\/p>\n\n\n\n<p>However Learned counsel for the husband- petitioner couldn\u2019t\nproduce any document regarding that his wife-respondent was actually practising\nand earning, <\/p>\n\n\n\n<p><strong>Jugement \u2013<\/strong><\/p>\n\n\n\n<p>The court noted that even though husband- petitioner claimed\nthat her wife was well off, he could not produce any document in support of the\nsame. Thus, the court refused to interfere with the order of the\nfamily court. And held <\/p>\n\n\n\n<p>\u201cThe petitioner&#8217;s aforementioned contention, in absence of\nany supporting document, remains a disputed question and needs to be tested\nin\u00a0trial. The Family Court has recorded in the impugned order that any\namount paid as maintenance in favour of the respondent\/wife and her minor child\nfor the period in question would be liable to be adjusted.\u201d<br>\n\u00a0The HC\nthus held that the previous order had no illegality in it and thus dismissed\nthe petition.\n\nReliance was placed on Shalija &#038; Anr. v.\nKhobbana, (2018) 12 SCC 199,wherein it was held that &#8216;capable of earning&#8217; and\n&#8216;actual earning&#8217; are two different requirements.
