However, she can file for a modification of the maintenance under Section 127 of the CrPC.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rachna_Kathuria_vs_Ramesh_Kathuria\"><\/span><a href=\"https:\/\/indiankanoon.org\/doc\/113760308\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rachna Kathuria vs Ramesh Kathuria<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\"><strong>The wife<\/strong> was already getting the maintenance from the respondent. She still filed an application under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/1933289\/\">Section 12<\/a>&nbsp;of the Protection of Women from&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/542601\/\">Domestic Violence Act<\/a>, 2005 (in short the Act) and along with it she filed an application under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/1771195\/\">Section 29<\/a>&nbsp;of the Act seeking maintenance.<strong>&nbsp;It is pertinent to note this law does not give additional rights to women to claim maintenance.<\/strong> This law is just to fast track the mechanism. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Ravindra_Haribhau_Karmarkar_Vs_Mrs_Shaila_R_Karmarkar\"><\/span><a href=\"https:\/\/indiankanoon.org\/doc\/468335\/\" target=\"_blank\" rel=\"noreferrer noopener\">Ravindra Haribhau Karmarkar Vs Mrs. Shaila R. Karmarkar<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">She can not be allowed to ride two horses at a time (two simultaneous proceedings in two different Courts) and could not be permitted to continue the maintenance proceedings u\/s. 125 of Cr.P.C. The <a href=\"https:\/\/lexforti.com\/legal-news\/independence-of-judiciary-a-getaway-tool-used-by-the-indian-judiciary-after-violating-natural-justice\/\" target=\"_blank\" rel=\"noreferrer noopener\">natural justice <\/a>demands that parallel proceedings cannot be allowed to continue in different Courts.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_separate_income_of_wife_a_determinant_for_maintenance\"><\/span>The separate income of wife, a determinant for maintenance? <span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Bhagwan_Dutt_Vs_Kamla_Devi_and_Ors_Supreme_Court\"><\/span><a href=\"https:\/\/indiankanoon.org\/doc\/138019\/\" target=\"_blank\" rel=\"noreferrer noopener\">Bhagwan Dutt Vs Kamla Devi and Ors.<\/a> (Supreme Court)<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\"><strong>The separate income and means of the wife can be taken into account in determining the <a href=\"https:\/\/lexforti.com\/legal-news\/retirement-is-not-a-ground-to-reduce-maintenance-amount\/\" target=\"_blank\" rel=\"noreferrer noopener\">amount of maintenance<\/a> payable to her under s. 488, <a href=\"https:\/\/lexforti.com\/legal-news\/shah-bano-case-section-125-of-criminal-procedure-code-is-secular-in-nature\/\" target=\"_blank\" rel=\"noreferrer noopener\">Criminal Procedure Code, 1898<\/a>.<\/strong> The section does not confer an absolute right on a neglected wife to get an order of maintenance against the husband nor does it impose absolute liability on the husband to support her in all circumstances.  The use of the word, may&#8217; in s. 488(1) indicates that the power conferred on the Magistrate is discretionary, though the discretion must be exercised in a judicial manner consistent with the language of the statute and with due regard to other relevant circumstances of the case. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"When_wife_filed_for_maintenance_under_two_different_Laws\"><\/span>When wife filed for maintenance under two different Laws.<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Renu_Mittal_Vs_Anil_Mittal_Ors_Delhi_HC\"><\/span><a rel=\"noreferrer noopener\" href=\"https:\/\/indiankanoon.org\/doc\/184046290\/\" target=\"_blank\">Renu Mittal Vs Anil Mittal &amp; Ors.<\/a> (Delhi HC)<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">For granting maintenance, a party can either approach the Court of Metropolitan Magistrate under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/542601\/\">Domestic Violence Act<\/a>&nbsp;soon after commissioning of Domestic Violence; <strong>or<\/strong> under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/1056396\/\">Section 125<\/a>&nbsp;Cr. P.C. claiming maintenance. <\/p>\n\n\n\n<p class=\"has-text-align-justify\">The Jurisdiction for granting maintenance under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/1056396\/\">Section 125<\/a>&nbsp;Cr. P.C. and&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/542601\/\">Domestic Violence Act<\/a>&nbsp;is parallel jurisdiction and if maintenance has been granted under&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/1056396\/\">Section 125<\/a>&nbsp;Cr.
