{"id":552,"date":"2020-04-23T10:30:00","date_gmt":"2020-04-23T10:30:00","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=552"},"modified":"2021-01-17T11:46:56","modified_gmt":"2021-01-17T11:46:56","slug":"simultaneous-appearance-in-two-examination-conducted-by-two-different-boards-is-not-permissible","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/simultaneous-appearance-in-two-examination-conducted-by-two-different-boards-is-not-permissible\/","title":{"rendered":"SIMULTANEOUS APPEARANCE IN TWO EXAMINATION CONDUCTED BY TWO DIFFERENT BOARDS IS NOT PERMISSIBLE"},"content":{"rendered":"\n<p>Rabia Basaria | Panjab University, Chandigarh | 1st February 2020<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Kuldeep Kumar\u00a0Pathak vs.\u00a0State\u00a0of\u00a0U.P.\u00a0and others Civil Appeal No.11 of 2016<\/strong><\/h4>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>FACTS:-<\/strong><\/h4>\n\n\n\n<ul><li>Appellant successfully passed the intermediate examination conducted\u00a0by Madhyamik Shiksha Parishad, U.P.,\u00a0Allahabad, 2002<\/li><li>On that basis appellant successfully pursued\u00a0the\u00a0Bachelor\u00a0in Arts (B.A.), then\u00a0Master\u00a0in Arts(M.A.), after that LL.B<\/li><li>But before appellant could enrolled himself as an advocate, on 20\u00a0April,\u00a02011,\u00a0the respondent -authorities cancelled his Intermediate Examination result of 2002 conducted by Madhyamik\u00a0Shiksha\u00a0Parishad, Allahabad and also ordered to confiscate his certificate.<\/li><li>Due to the effect of\u00a0this order the further courses which appellant had passed in the meantime is also nullified.<\/li><li>The reason of\u00a0cancelling the\u00a0Intermediate\u00a0Examination\u00a0was that appellant had appeared in two examination\u00a0conducted by two different boards simultaneously, one-U.P. Board\u00a0of\u00a0High School and Intermediate Examination (Herein U.P. Board)\u00a0and other- Sanskrit Board with respect to class X and equivalent Examination.<\/li><li>Aggrieved by the order dated\u00a020 April, 2011,\u00a0the appellant on 10 May,2011,\u00a0made a request before the respondent\u00a0but\u00a0without hearing appellant, the respondent passed the order on 18\u00a0May2011,\u00a0giving effect to the order passed on\u00a020\u00a0April,\u00a02011.<\/li><li>Against this order the appellant filed the writ petition before the high court but same was also dismissed.\u00a0<\/li><li>At last the appellant filed the appeal before the Supreme Court challenging the judgement of High Court.<\/li><li>The Learned Senior Counsel for appellant submitted before the Supreme Court that the judgment of High Court [High Court held that appearance in two examinations simultaneously for same year is in violation of the Regulation of the Board] is unsustainable because not such regulation is shown by the Board. The Learned Senior Counsel further argued that the order of confiscating the appellant\u2019s certificate of\u00a0Intermediate\u00a0Examination\u00a0is against the\u00a0Principle\u00a0of\u00a0Natural\u00a0Justiceas opportunity of hearing was not given to the appellant before such order.<\/li><\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>HELD:-<\/strong><\/h4>\n\n\n\n<p>It is held that the respondent failed to show the regulation which makes the appearance in two examination by the appellant in the same year is not\u00a0\u00a0permissible, which leads that judgement of High\u00a0Court\u00a0is erroneous.
