{"id":560,"date":"2020-04-23T10:30:00","date_gmt":"2020-04-23T10:30:00","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=560"},"modified":"2021-01-17T11:46:40","modified_gmt":"2021-01-17T11:46:40","slug":"for-finding-aggressor-entire-incident-must-be-thoroughly-considered","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/for-finding-aggressor-entire-incident-must-be-thoroughly-considered\/","title":{"rendered":"FOR FINDING AGGRESSOR, ENTIRE INCIDENT MUST BE THOROUGHLY CONSIDERED"},"content":{"rendered":"\n<p>Rabia Basaria | Panjab University, Chandigarh | 3rd February 2020<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Dashrath @ Jolo &#038;\u00a0<\/strong><strong>Ors<\/strong><strong>.\u00a0<\/strong><strong>Vs.<\/strong><strong>\u00a0State of Chhattisgarh<\/strong><strong><\/strong><strong>Criminal Appeal Nos.197-198 of 2018<\/strong><\/h4>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>FACTS:-<\/strong><\/h4>\n\n\n\n<ul><li>Herein:-\u00a0<\/li><\/ul>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0PW-14\u00a0Chumbai<\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0PW-17 Gayatri Bai<\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0PW-19 Birichram<\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0PW-20 Dilip Kumar Yadav<\/p>\n\n\n\n<p>\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0PW-21 Rajesh Yadav<\/p>\n\n\n\n<ul><li>On 03-08-2008, around 1:30pm PW-19 went to the house of Bhojram for inviting him for the sixth day birth of his child (Chhati).<\/li><li>The appellants who were neighbours of Bhojram standing in front of their houses and they threatened PW-19 that they will kill him.\u00a0<\/li><li>When PW-19 asked the appellants\u00a0who were armed not to abuse, the appellants assaulted PW-19.<\/li><li>PW-14 &#038; PW-17 who were coming towards the spot tried to intervene in the incident.<\/li><li>At the same time Chhedilal who was also coming towards the spot requested the appellants\u00a0not to beat PW-19, but the appellants\u00a0leaving PW-19\u00a0started assaulting Chhedilal. Phodal @ Duryodhan crushed the head of Chhedilal by blunt\u00a0part\u00a0of the battleaxe.<\/li><li>At the same time Bhuru\u00a0@ Parmanand, Bablu, PW-20 and PW-21 also came to the spot and tried to intervene but the appellants assaulted all of them and caused the death of Chhedilal,\u00a0Bablu and Bhuru @\u00a0Parmanand on the spot. PW-19 and PW-20 sustained injuries.<\/li><li>All the accused were arrested and based on their disclosure statement, battleaxe, kudari and sticks\u00a0recovered from Dashrath @ Jolo, Jagru @ Mohanlal and\u00a0Anad and Laxmi respectively.\u00a0Blood\u00a0stained clothes also recovered from accused.<\/li><li>All the seized articles were sent to\u00a0Forensic\u00a0Science Laboratory.<\/li><li>The Trail\u00a0Court\u00a0convicted all the eight accused\u00a0u\/s\u00a0302 IPC read with section 149 IPC and sentenced them to life time imprisonment. They were also convicted for other offences and sentenced to imprisonment.<\/li><li>Aggrieved,\u00a0all the accused filed the appeal before\u00a0High\u00a0Court\u00a0and during the pendency of appeal the accused\u00a0Phodol\u00a0@ Duryodhan and Mohanlal died.<\/li><li>High\u00a0Court\u00a0confirmed the conviction and sentence of imprisonment in\u00a0respect of appellants\u00a0(herein\u00a0Dashrath @ Jolo,\u00a0Anand &#038;\u00a0Laxmi) imposed upon them by\u00a0TrialCourt.\u00a0But\u00a0High court acquitted the two women accused viz. Dujmati and Triveni Bai.<\/li><li>For appellants,\u00a0Learned\u00a0Counsel&#8217;s\u00a0contention is that the incident took place in front of the house of the appellants\u00a0where the deceased and accused had gathered for celebration of bith of the child and only act of the accused could only be in their self-defense.
