Harsora and Ors vs Kusum Narottamdas Harsora and Ors, Civil Appeal NO.&nbsp; 10084 of 2016<\/strong><\/pre>\n\n\n\n<p><strong>Matter <\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">Kusum and her mother\nPushpa Harsora filed a complaint under Domestic Violence Act, 2005, against\nPradeep, the brother\/son, and his wife, and two sisters\/daughters, alleging\nvarious acts of violence against them. When no action was taken for over three\nyears then the mother and daughter filed two separate complaints against the\nrespondent. However, since the Section 2(q) of the Domestic Violence Act, 2005,\ncontains the expression of an \u2018adult male person\u2019, the complaints against the\nother respondents were dismissed. The three respondents who by law did not fall\nunder the expression of Section 2(q) of the Act were discharged. Thus, in this\ncase the mother and daughter have filed a writ petition challenging the\nconstitutional validity of Section 2(q) of the &nbsp;&nbsp;&nbsp;&nbsp; Domestic\nViolence Act, 2005. <\/p>\n\n\n\n<p><strong>Appellant\u2019s Contention <\/strong><\/p>\n\n\n\n<ul><li>It\nalleged that as per Section 2(q) of the Domestic Violence Act, a complaint of\ndomestic violence can be lodged only against an, \u2018adult male person.\u2019<\/li><li>It\nstated that the Domestic Violence Act, 2005, is a penal statute and should be strictly construed in the\nevent of any ambiguity. He further added that the expression of \u2018adult male\nperson\u2019 cannot be diluted in any manner, as it was done by the High Court.&nbsp; &nbsp;<\/li><li>It submitted\nthat reading down cannot be equated to re-reading in constitutional law.<\/li><li>No provision\ncan be inserted or added into the main provision in order to distort the\nlanguage.<\/li><li>Only the\nparliament has the right to make changes to any of the provisions of a specific\nAct or the Act itself. Thus, the High Court has distorted the language and\nexercised power which it did not possess. <\/li><\/ul>\n\n\n\n<p><strong>Respondent\u2019s Contention <\/strong><\/p>\n\n\n\n<ul><li>It alleged\nthat the Domestic Violence Act, 2005, was enacted to protect women from all\nkinds of violence. Thus, any definition which seeks to restrict the reach of\nthe Act would have to be either struck down as being violative of&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/367586\/\">Article 14<\/a>&nbsp;of the Constitution or read down.<\/li><li>It stated\nthat the expression of \u2018adult male person\u2019, is not based on any intelligible\ndifferentia, and in order to protect women the term can be widened by the\ncourt. <\/li><li>It submitted\nthat the expression is contrary to the object of the act. The purpose of the\nAct is to protect women from violence faced and thereby provide her with\njustice. <\/li><li>The High\nCourt was right, and that if the said expression is not struck down, it ought\nto be read down in the manner suggested to make it constitutional. <\/li><li>It stated\nthat as per Section 2(s) of the Domestic Violence Act, 2005, the expression of\n\u2018shared household\u2019, may also include members of joint family. <\/li><li>The amendments\nmade to the Hindu Succession Act, have made females coparceners to the joint\nHindu family. Thus, if amendments are made to provide women their rights then\nthe same should be done in the Domestic Violence Act, 2005, and the expression\n\u2018adult male person\u2019 should be broadened. <\/li><\/ul>\n\n\n\n<p><strong>Issues Raised<\/strong><\/p>\n\n\n\n<ul><li>The\nmain issue in this case is that whether a case of violence under Domestic\nViolence Act, 2005, can be filed against female relatives of the adult male\nperson. <\/li><\/ul>\n\n\n\n<p><strong>Held <\/strong><\/p>\n\n\n\n<ul><li>It set aside\nthe impugned judgment of the Bombay High Court and declared that the words\n\u201cadult male\u201d in&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/582753\/\">Section 2(q)<\/a>&nbsp;of the 2005 Act will stand deleted since\nthese words do not square with&nbsp;<a href=\"https:\/\/indiankanoon.org\/doc\/367586\/\">Article 14<\/a>&nbsp;of the Constitution of India.&nbsp;<\/li><li>The two\ncomplaints of 2010, in which the three female respondents were discharged\nfinally, were purported to be revived, despite there being no prayer in Writ\nPetition No.300\/2013 for the same.&nbsp; <\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Falgu Mukati | Pravin Gandhi College of Law | 23rd February 2020&nbsp; Hiral P.
