This case had initially arisen in Family Court and had reached the Supreme Court. The husband Soumitra Nahar and wife Parul Nahar had a son Master Shravan and a daughter Sanjana. After the birth of their second child certain disputes cropped in the relationship, which led to unfortunate personal allegations and counter allegations. As a result, the husband filed Guardianship Petition under \u00a0Sections\u00a07,8,10\u00a0and 11 of the Guardian and Wards Act, 1890. Thus, the wife filed a separate Divorce Petition on\u00a0the\u00a0grounds\u00a0of\u00a0cruelty\u00a0and\u00a0adultery. Thereafter, the appellant\u2019s father filed a suit praying\u00a0 for\u00a0 mandatory\u00a0 injunction\u00a0against\u00a0the\u00a0respondent\u00a0 wife\u00a0from entering\u00a0into\u00a0his\u00a0self-acquired\u00a0property.\u00a0Thus, the case of custody of children was fought by the couple in various courts and various different orders of consent were passed in this case. \u00a0<\/p>\n\n\n\n<p><strong>Appellant\u2019s Contention <\/strong><\/p>\n\n\n\n<ul><li>It submitted that except the Divorce\u00a0Petition\u00a0HMA\u00a0No.\u00a0821\u00a0of\u00a02011, no other proceeding with reference to the custody of the minor children is pending in the competent court. <\/li><li>At present both of the children are not in custody of either of the parents. Thus, the custody of both the minor children should be granted to him, since the children are living without either of the parent for quite a long time. <\/li><li>It stated that the appellant should be allowed to make all provisions regarding to ensure the safety and security of the children and also take appropriate measures which\u00a0are\u00a0in\u00a0the\u00a0interest\u00a0for upbringing\u00a0of\u00a0the\u00a0children.<\/li><\/ul>\n\n\n\n<p><strong>Respondent\u2019s Contention <\/strong><\/p>\n\n\n\n<ul><li>It\nsubmitted that both the paternal grandparents of the children have passed away,\nand thus, there is no one as such who would have a positive influence on the\nchildren and who would look after the well-being and cultural growth of the\nchildren. <\/li><li>There\nis no female member in the appellant\u2019s house who could look after the needs and\nnecessities of the daughter. <\/li><li>The respondent\u00a0should be\u00a0permitted\u00a0to\u00a0withdraw\u00a0her\u00a0consent\u00a0to\u00a0the\u00a0settlement\u00a0which\u00a0had\nbeen\u00a0reached\u00a0at\u00a0one\u00a0stage\u00a0between\u00a0the\u00a0parties\u00a0and\u00a0recorded\u00a0by\u00a0the\nHigh\u00a0Court\u00a0of\u00a0Delhi.<\/li><li>The parents should not be arbitrarily\ndenied access to their children and should be allowed to meet their children as\nper the rules of the college. <\/li><li>Any foreign trips or major activities\norganised by the school wherein the children are required to participate must\nreceive the consent of either of the parents. <\/li><li>It submitted that the respondent should be\nallowed to view the academic reports and other extra-curricular accolades which\nwas denied by the appellant.<\/li><\/ul>\n\n\n\n<p><strong>Held <\/strong><\/p>\n\n\n\n<ul><li>the Court is of \u00a0 the \u00a0 view \u00a0 that \u00a0 the \u00a0 interim arrangement which has been made by this court vide its\u00a0Order dated\u00a07<sup>th<\/sup> September,\u00a02017\u00a0and\u00a0orders\u00a0passed\u00a0thereafter\u00a0shall continue\u00a0with\u00a0a\u00a0liberty to the parties to file independent proceedings for the custody or guardianship of the minor children before the competent court of jurisdiction which, if instituted, may be decided independently in accordance with law and that alone would be in the paramount interest of the children.\u00a0 <\/li><li>The consent which\u00a0was recorded\u00a0by\u00a0the\u00a0High\u00a0Court\u00a0of\u00a0Delhi\u00a0in\u00a0its\u00a0Order\u00a0dated\u00a01st\u00a0March, 2013, will\u00a0remain\u00a0operative\u00a0until the\u00a0parties\u00a0to\u00a0the\u00a0consent\u00a0order\u00a0jointly\u00a0move\u00a0an\u00a0application\u00a0for withdrawal\u00a0of\u00a0their\u00a0consent. <\/li><li>With regards to the question that the school authorities should obtain the consent of the parent for any educational\/ recreational trip, and the financial constraint of the appellant which has led to the denial of basic etiquettes to the children can be examined\u00a0or\u00a0tried\u00a0in\u00a0the\u00a0custody proceedings as and when\u00a0filed\u00a0by\u00a0the\u00a0concerned\u00a0party. If\u00a0such\u00a0a\u00a0grievance\u00a0is\u00a0raised\u00a0before\u00a0the appropriate forum under the\u00a0law,\u00a0certainly\u00a0it\u00a0may\u00a0be\u00a0looked\u00a0into and may be decided independently without being influenced by\u00a0the observations being made by this court\u00a0expeditiously\u00a0in\u00a0accordance with\u00a0law.<\/li><\/ul>\n\n\n\n<ul><li>The\u00a0interim arrangement\u00a0made\u00a0by\u00a0this\u00a0Court\u00a0regarding\u00a0the\u00a0custody\/visitation rights of the parties vide\u00a0order\u00a0dated\u00a07<sup>th<\/sup> September,\u00a02017\u00a0and further subsequent orders shall continue until further orders with the liberty to the parties to take steps in filing of a custody\/guardianship petition for the minor\u00a0children\u00a0before\u00a0the competent\u00a0Court\u00a0of\u00a0jurisdiction. <\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Falgu Mukati | Pravin Gandhi College of Law | 23rd February 2020\u00a0 Soumitra Kumar Nahar vs Parul Nahar, Civil\u00a0Appeal\u00a0NO(S).1671\u00a0OF\u00a02020 Matter \u00a0The present case is of a custody for children.
