{"id":631,"date":"2020-04-23T10:30:07","date_gmt":"2020-04-23T10:30:07","guid":{"rendered":"http:\/\/lexforti.com\/legal-news\/?p=631"},"modified":"2021-01-17T11:47:55","modified_gmt":"2021-01-17T11:47:55","slug":"supreme-court-issues-an-order-prescribing-fixed-timelines-for-listing-the-death-penalty-in-cases-of-criminal-appeals","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/supreme-court-issues-an-order-prescribing-fixed-timelines-for-listing-the-death-penalty-in-cases-of-criminal-appeals\/","title":{"rendered":"Supreme Court issues an Order prescribing fixed timelines for listing the Death penalty in cases of Criminal Appeals"},"content":{"rendered":"\n<p><strong> Aditi Reddy M\u00a0|\u00a0Symbiosis Law School, Hyderabad |\u00a024th February 2020\u00a0 <\/strong><\/p>\n\n\n\n<p>An office order\nwhich lays down the timelines and guidelines for the listing of the Criminal Appeals\ninvolving DEATH PENALTY was released by the Supreme Court on the 12<sup>th<\/sup>\nFebruary, 2020. <\/p>\n\n\n\n<ol><li>In the matter relating to the Death Penalty\nwhich have been confirmed or upheld by the High Court and Supreme Court had\ngranted leave that the appeal shall be listen not later than six months before\nthe Three Judge Bench from the date of the grant of leave and whether the fact\nthat the appeal is ready or not is completely immaterial.<\/li><li>As soon as Special Leave Petition which\ninvolves a death penalty is filed, the concerned Registry is required to\nexpeditious intimation to the lower court from which it has been appealed, so\nthat the original record along with the Certificate of Service may be\ndispatched to the Supreme Court with a period of 60 days or any other further\nperiod which has been fixed by the court. In case there are any documents in\nthe vernacular language, such documents are also to be filed along with the\nSLP. <\/li><li>After the leave has bee22n granted by the court\nthe registry must insist the parties to file the additional documents within a\nperiod of thirty days after such a receipt o the intimidation from the Registry\nin this regard. <\/li><li>If in case the parties do not file the records\nor the additional documents then the matter may be listed in the Chambers of\nthe Judger with necessary office reports with directions, instead of f\npracticing the present method of listing the such matters in front of the\nRegistrar\u2019s Court. <\/li><\/ol>\n\n\n\n<p>\n\n\n\n\n\n\n\nThe\nSupreme court had made a clear statement saying the aforesaid rules have to be\nfollowed by all the branches dealing with the Criminal Matters and the Listing\nbranches.\n\n\n\n<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aditi Reddy M\u00a0|\u00a0Symbiosis Law School, Hyderabad |\u00a024th February 2020\u00a0 An office order which lays down the timelines and guidelines for the listing of the Criminal Appeals involving DEATH PENALTY was released by the Supreme Court on the 12th February, 2020.
