Principal sir Syed Institute for Technical Studies &#038; Anr<\/strong><\/p>\n\n\n\n<p><strong>Background:<\/strong><\/p>\n\n\n\n<ul><li>The\nKerala State Electricity Regulatory Commission had issued a notification which\nwas dated on the 26<sup>th<\/sup> of November 2007 categorising that the SFEIs\nunder the head of Low Tension VII(A) Commercial. <\/li><li>The\nGovernment run or aided private educational institutions have been placed under\nthe Low Tension VI Non-Domestic tariff category. The commission here is the\nappellant before us in these set of appeals. <\/li><li>So\nsuch a tariff notification was published in the Kerala State Electricity\nRegulatory Commission Regulations,2006.<\/li><li>Subsequently\nthere were several writ petitions filed by different SFEIs questioning the\nlegality of such a segregation which in effect had created high tariff regime\nfor them. Altogether there were 52 writ petitions filed in the Kerala High\nCourt. <\/li><li>The\nlearned council had opined that the tariff order was to be valid by considering\nthe decision of the bench in the T.M.A Pai Foundation vs State of Karnataka. <\/li><\/ul>\n\n\n\n<p><strong>Issues:<\/strong><\/p>\n\n\n\n<ul><li>Whether\nunder the 2003 Act, the differentiation of SFEIs from the other set of\neducational institutions for the purpose of fixing of tariff was arbitrary\ndiscrimination and antithetical to principles of natural justice.<\/li><\/ul>\n\n\n\n<p><strong>Held: <\/strong><\/p>\n\n\n\n<ul><li>The\nSupreme court had allowed the appeal and had held that the Commission was\nacting within its right as a tariff fixing body to distinguish the\n&#8220;purpose&#8221; of respective categories of educational institutions as the\nmeans to have an end was not similar in terms of its nature for both the institutions.<\/li><li>\u00a0While both imparted education, the State run\n&#038; aided institutions were also discharging their duties of welfare of its\ncitizens.<\/li><li>The\nexpression &#8220;purpose&#8221; has to be comprehended in a way that the character\nof the body which is taking up the activity of imparting education. While\nfunding educational institutions, the State undertakes to discharge one of its\nessential welfare measures.<\/li><li>The\nBench further emphasized that fixing higher tariffs is specifically for the\nSFEIs and not on the State running educational institutions would not amount to\ngiving &#8220;undue preference&#8221; to State aided institutions in terms of the\ntariff notification as the purposes of both the entities might be clearly and\nduly differentiated.<\/li><li>The\ncourt further deliberated that &#8220;The fact that SFEIs have been clubbed\ntogether with several commercial service providers wholly unrelated to\neducation becomes insignificant once we find that purpose of the SFEIs could be\ndifferentiated from the Government run and Government aided educational\ninstitutions\u201d<\/li><li>Finally\nthe judgements held that the tariff fixing body was not required to proceed\nsolely on the basis of &#8220;nature of service&#8221; rendered by the\nInstitution while fixing tariifs.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>Aditi Reddy M\u00a0|\u00a0Symbiosis Law School, Hyderabad |\u00a024th February 2020 Kerala State Electricity Board rep. by its secretary &#038; anr v.
