Kameshwar Singh<\/a><\/li><\/ul><\/li><\/ul><\/nav><\/div>\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Introduction\"><\/span>Introduction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">If anything is prohibited directly then it is also prohibited indirectly. Under the colour or guise of power given for one particular purpose, the legislature cannot seek to achieve some other purpose which it is otherwise not competent to legislate on. This doctrine is for the \u2018Legislative\u2019 organ which is out of the three organs of the State.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"The_relevance_of_the_Doctrine_of_Colourable_Legislation\"><\/span>The relevance of the Doctrine of Colourable Legislation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\"><a href=\"https:\/\/indiankanoon.org\/doc\/77052\/\" target=\"_blank\" rel=\"noreferrer noopener\">Article 246 of the Indian Constitution<\/a> has separate subjects for law-making in three lists under VII Schedule. That is, it has segregated numerous subject matters, each subject matter is associated with either State, Centre or Both.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">For example: If in Union list, use of army has been bestowed upon the Central Government, then State government cannot claim upon such rights.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Lists\"><\/span>Lists<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Followings are the lists under <a href=\"https:\/\/en.wikipedia.org\/wiki\/Seventh_Schedule_to_the_Constitution_of_India#:~:text=The%20Seventh%20Schedule%20to%20the,List%20and%203)%20Concurrent%20List.\" target=\"_blank\" rel=\"noreferrer noopener\">Schedule VII of Indian Constitution<\/a>, through which Centre, State or both can legislate upon any subject matter:<\/p>\n\n\n\n<ol type=\"1\"><li>Union List (List I)<\/li><li>State List (List II)<\/li><li>Concurrent List (List III)<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"A_question\"><\/span>A question<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">If a subject matter is in the State List, then Union cannot legislate upon such matter; and if a subject matter is in the Union List, then State cannot legislate upon such matter.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">But what if, incompetent legislature tries to legislate upon a subject matter out of its jurisdiction?<\/p>\n\n\n\n<p>Or<\/p>\n\n\n\n<p class=\"has-text-align-justify\">What if, to do so, it tries to incorporate a law, which has a guise of a different colour, but the main intention is to legislate upon the subject matter, which is outside of its jurisdiction?<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Role\"><\/span>Role<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">This is where the Doctrine of Colourable Legislation comes into the picture.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">If the legislature tries to legislate upon such subject matter, which is outside the scope of its power, and it does so indirectly so that it does not look like that it has legislated upon a law outside of its scope; then such instance is called Colourable Legislation.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">In such a situation, Constitutional Courts like the Supreme Court or High Court can invalidate such law by the usage of this doctrine. (Doctrine of Colourable Legislation)<\/p>\n\n\n\n<p class=\"has-text-align-justify\"><strong>Example:<\/strong> \u00a0Under Union List, Entry 2A, deployment of <a href=\"https:\/\/lexforti.com\/legal-news\/members-of-the-armed-forces-are-a-distinct-and-distinguishable-class\/\" target=\"_blank\" rel=\"noreferrer noopener\">armed forces <\/a>come under the purview of Central Government. State Government cannot legislate upon such subject matter. In-State List, Entry 1, makes the \u2018public order\u2019 aspect under the State List. Now <a href=\"https:\/\/lexforti.com\/legal-news\/state-cannot-take-away-liberties-under-a-mere-apprehension-of-a-law-and-order-situation-must-create-atmosphere-conducive-to-freedom\/\" target=\"_blank\" rel=\"noreferrer noopener\">State cannot make a law for public order,<\/a> which involves deployment of armed forces. It will become a Colourable Legislation. In such a situation, Constitutional Court like Supreme Court or High Court; by virtue of Doctrine of Colourable legislation, will invalidate such law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Limitations_on_the_Doctrine_of_Colourable_Legislation\"><\/span>Limitations on the Doctrine of Colourable Legislation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">This Doctrine will not work on such instances, where Legislature has no Constitutional Limitation.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">It is not applicable to Subordinate Legislation<\/p>\n\n\n\n<p class=\"has-text-align-justify\">Not concerned if the Law is relevant or irrelevant<\/p>\n\n\n\n<p class=\"has-text-align-justify\">The presumption is always in the favour of Constitutionality of Law and the burden to prove is upon the Petitioner.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Case_Laws_on_The_Doctrine_of_Colourable_Legislation\"><\/span>Case Laws on The Doctrine of Colourable Legislation<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"KC_Gajapati_Narayana_Deo_and_Ors_v_The_State_of_Orissa\"><\/span><a href=\"https:\/\/indiankanoon.org\/doc\/1248239\/\" target=\"_blank\" rel=\"noreferrer noopener\">K.C. Gajapati Narayana Deo and Ors. v. The State of Orissa<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\"><em>If the Constitution of a State distributes the legislative powers amongst different bodies, which have to act within their respective spheres marked out by specific legislative entries, or if there are limitations on the legislative authority in the shape of fundamental rights, questions do arise as to whether the legislature in a particular case has or has not, in respect to the subject-matter of the statute or in the method of enacting it, transgressed the limits of its constitutional powers.<\/em><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"State_of_Bihar_v_Kameshwar_Singh\"><\/span><a href=\"https:\/\/indiankanoon.org\/doc\/49043\/\" target=\"_blank\" rel=\"noreferrer noopener\">State of Bihar v. Kameshwar Singh<\/a><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">In this case, the Court applied the concept of Doctrine of Colourable legislation and declared a law invalid. The law held invalid was Bihar Land Reforms Act 1950.
