After the birth the doctors felt that the mother needed\nblood and so the husband and the husbands brother had offered to transfuse\ntheir blood to her. After such a transfusion the mother expired. <strong><\/strong><\/li><li>By the following the\nfacts of the case the brother of Santhosh Rani\u2019s husband had filed an FIR with\nthe police and allege the hospital saying that the patient was not attended\nafter the transfusion of the blood from 2.30pm to 2.00am. Here it was also\nimportant to note that the transfusion of the blood from the husband and his\nbrother was taken by the dispenser and the Dr. Agnihotri. It was also important\nto state that the two persons blood was tested and then only it was transfused\nto Santhosh Rani and the oxygen was also administered. <strong><\/strong><\/li><\/ul>\n\n\n\n<p><strong>Held<\/strong>:<\/p>\n\n\n\n<ul><li>The Trial court had\ndischarged the application of the accused by referring to the Jacob Mathew\u2019s\ncase. <\/li><li>Later the Additional\nSessions Judge had set aside the order of the discharge and in its revision it\nwas upheld <\/li><li><em>In\n<strong>Jacob Mathew vs State of Punjab(2005)\n6 SCC 1<\/strong>, the court clearly stated to prosecute the medical\nprofessionals for negligence under the criminal law, the party must be able to\nprove something more than mere negligence as they are the people who deal with\nthe dying patient and they are certainly expected to take the best decisions in\nthat circumstance of the case. In case if such decisions do not result well\nstill that would not let the medical professionals guilty of criminal\nnegligence. Such a medical profession may be liable to pay damages but unless negligence\nof\u00a0 a high\u00a0 order is shown\u00a0 the medical professionals should not be\ndragged into criminal proceedings.<\/em><\/li><li><em>The\ncourt by reiterating the judgement in Jacob Mathew case had stated that in any\ncase of criminal negligence against a medical professional it must show that\nthe accused had committed something or failed to do something which should have\nbeen done in ordinary prudence of the professional. The court had also opined\nthat in such cases independent opinion of another doctor should be obtained in\nthis regard. <\/em><\/li><li>The Supreme Court in this\ncase had set aside the judgements of the High Court ad restored the order of\nthe Trial Court and discharge the appellants saying that in the present case\nthe prosecution failed to take an opinion of another independent doctor. Also,\nthe postmortem report does not show that Santhosh Rani and not expired because\nof the transfusion of the blood. The only negligence that could be attributed\nto the accused is that they carried out the blood transfusion in violation of\nsome instructions issued by the Chief Medical Officer that blood should be\nobtained from a licensed blood bank and that no direct blood transfusion from\nthe donor to the patient should be done.<\/li><\/ul>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aditi Reddy M\u00a0|\u00a0Symbiosis Law School, Hyderabad |\u00a024th February 2020 Anjana Agnihotri &#038; Anr. v.
