promulgated an ordinance on&nbsp;<a href=\"https:\/\/www.thehindu.com\/news\/national\/uttar-pradesh-cabinet-clears-ordinance-against-love-jihad\/article33170627.ece\" target=\"_blank\" rel=\"noreferrer noopener\">unlawful conversion<\/a>&nbsp;days after it was passed by the&nbsp;<a href=\"https:\/\/www.thehindu.com\/news\/national\/other-states\/yogi-adityanath-vows-tough-law-against-love-jihad\/article32992138.ece\" target=\"_blank\" rel=\"noreferrer noopener\">Yogi Adityanath-led State cabinet<\/a>, officials said on Saturday.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Key_Definitions\"><\/span>Key Definitions<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Followings are the eleven key definitions in the Uttar Pradesh&#8217;s new anti-conversion Law of 2020 (Prohibition of Unlawful Conversion of Religion Ordinance 2020.)<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Allurement\"><\/span>Allurement<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>It means and includes offer of any temptation in the form of:<\/p>\n\n\n\n<ol><li>any gift, gratification, easy money or material benefit either in cash or kind;<\/li><li>employment, free education in reputed <a href=\"https:\/\/lexforti.com\/legal-news\/private-school-is-entitled-to-impart-religious-instruction-or-study-based-on-religious-pluralism\/\" target=\"_blank\" rel=\"noreferrer noopener\">school run by any religious body<\/a>; or<\/li><li>better lifestyle, divine displeasure or otherwise.<\/li><\/ol>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Coercion\"><\/span>Coercion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Compelling an individual to act against his\/her will by the use of psychological pressure or physical force causing bodily injury or threat thereof;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Conversion\"><\/span>Conversion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Renouncing one&#8217;s own religion and adopting another religion<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Force\"><\/span>Force<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Show or force or a threat of injury of any kind to the person converted or sought to be converted or to any other person or property.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Fraudulent\"><\/span>Fraudulent <span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">It means and includes impersonation (any kind\/by false name, surname, religious symbol) or otherwise;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Mass_Conversion\"><\/span>Mass Conversion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>When two or more persons are converted.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Minor\"><\/span>Minor<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Person under the age of eighteen years of age.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Religion\"><\/span>Religion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Any organized system of worship pattern, faith belief, worship or lifestyle, as prevailing in India or any part of it, and defined under any law or custom for the time being in force<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Religion_Convertor\"><\/span>Religion Convertor<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Person of any religion who performs any act of conversion from one religion to another religion and by whatever name he is called such as Father, Karmkandi, Maulvi or Mulla, etc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Undue_Influence\"><\/span>Undue Influence<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p class=\"has-text-align-justify\">Unconscientious use by one person of his\/her power or influence over another in order to persuade the other to act in accordance with the will of the person exercising such influence.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Unlawful_Conversion\"><\/span>Unlawful Conversion<span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<p>Any conversion not in accordance with law of the land.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_this_Law_Prohibits\"><\/span>What this Law Prohibits?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>Law prohibits religious conversion by misrepresentation, force, undue influence, coercion, allurement or by any fraudulent means. Even through marriages, there shall be no conversion. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_is_says_about_Inter-faith_Marriage\"><\/span>What is says about Inter-faith Marriage?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Under Section 6 of the Ordinance that, if the marriage was done with the sole purpose of unlawful conversion <strong>by a man of one religion with the women of another religion<\/strong>; where either he himself converted before or after the marriage or the woman converted herself before or after the marriage; the Family Court will declare such marriage to be void. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Rules_for_valid_Conversion\"><\/span>Rules for valid Conversion<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ol><li>Under Section 8(1) Person who wants to convert has to give a declaration; 60 days in advance to the District Magistrate or Additional District Magistrate.<\/li><li>Under Section 8(2) Religious convertor has to give one month&#8217;s advance notice to the District Magistrate or any officer not below the rank of Additional District Magistrate; who will be appointed by the District Magistrate for the purpose of such ceremony.<\/li><li>Under Section 8(3) When District Magistrate receives information either by the person who want to convert or by a Religious Convertor as per the above two clauses; shall conduct a Police enquiry to clear the intention.<\/li><li>Under Section 9(1) and (3) Once a person gets converted, he has to send a declaration to the District Magistrate within sixty days of his\/her conversion stating his present address, date of conversion, spouse or parent&#8217;s name, the current and past religion, etc.<\/li><li>Under Section 9(4), once the declaration is given to the District Magistrate under Section 9(1) and (3); he\/she has to appear before the District Magistrate within 21 days for identification purpose.<\/li><li>If any of the clauses i.e. Section 9(1) to (4) is breached, then such conversion will become void and illegal.<\/li><\/ol>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Punishments\"><\/span>Punishments<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n<figure class=\"wp-block-embed-youtube wp-block-embed is-type-video is-provider-youtube\"><div class=\"lyte-wrapper fourthree\" title=\"Punishment under Prohibition of Unlawful Conversion of Religion Ordinance, 2020\" style=\"width:420px;max-width:100%;margin:5px;\"><div class=\"lyMe\" id=\"WYL_EniGorx_7ak\" itemprop=\"video\" itemscope itemtype=\"https:\/\/schema.org\/VideoObject\"><div><meta itemprop=\"thumbnailUrl\" content=\"https:\/\/i.ytimg.com\/vi\/EniGorx_7ak\/hqdefault.jpg\" \/><meta itemprop=\"embedURL\" content=\"https:\/\/www.youtube.com\/embed\/EniGorx_7ak\" \/><meta itemprop=\"duration\" content=\"PT1M2S\" \/><meta itemprop=\"uploadDate\" content=\"2020-11-29T14:23:12Z\" \/><\/div><div id=\"lyte_EniGorx_7ak\" data-src=\"https:\/\/i.ytimg.com\/vi\/EniGorx_7ak\/hqdefault.jpg\" class=\"pL\"><div class=\"tC\"><div class=\"tT\" itemprop=\"name\">Punishment under Prohibition of Unlawful Conversion of Religion Ordinance, 2020<\/div><\/div><div class=\"play\"><\/div><div class=\"ctrl\"><div class=\"Lctrl\"><\/div><div class=\"Rctrl\"><\/div><\/div><\/div><noscript><a href=\"https:\/\/youtu.be\/EniGorx_7ak\" rel=\"nofollow\"><img src=\"https:\/\/i.ytimg.com\/vi\/EniGorx_7ak\/0.jpg\" alt=\"Punishment under Prohibition of Unlawful Conversion of Religion Ordinance, 2020\" width=\"420\" height=\"295\" \/><\/a><\/noscript><meta itemprop=\"description\" content=\"This video depicts the punishment provisions of the Newly passed Anti-conversion ordinance in Uttar Pradesh, also called as the Prohibition of Unlawful Conversion of Religion Ordinance, 2020. Popularly, it is also known as Love jihad law.\"><\/div><\/div><div class=\"lL\" style=\"max-width:100%;width:420px;margin:5px;\"> <a href=\"https:\/\/youtu.be\/EniGorx_7ak\" target=\"_blank\">Watch this video on YouTube<\/a>.<\/div><figcaption><\/figcaption><\/figure>\n\n\n<p class=\"has-text-align-justify\">If the above clause 1 (Section 8(1)) is violated, where a person who wishes to convert himself\/herself fails to declare his intentions sixty days prior in advance; then he would be for the term not less than <strong>six months and may be extended to three years.<\/strong> Fine shall not be less than <strong>Rs. 10,000\/-.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">If the above clause 2 (Section 8(2)) is violated, where the religious converter fails to give a one month notice; then, such person&#8217;s imprisonment term shall not be less than <strong>One Year<\/strong> and which may be extended to <strong>Five Years. <\/strong>The fine here would not be less than <strong>Rs. 20,000\/-.<\/strong><\/p>\n\n\n\n<p>Offences under this Ordinance will be <strong>Cognizable and non-bailable and triable by Court of Session.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">If it is an institution or organization then, the person or persons in charge will be punished with imprisonment <strong>not less than one year<\/strong>, extendable to <strong>five years. <\/strong>Here fine shall not be less than <strong>Rs. 15,000\/-.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-justify\">If the person unlawfully converted is a <strong>minor, a woman, a Scheduled Caste or Schedule Tribe<\/strong> <strong>person,<\/strong> then the punishment with imprisonment shall <strong>not be less than two years,<\/strong> extendable to <strong>ten years.<\/strong> Here fine shall not be less than <strong>Rs. 25,000\/-.<\/strong><\/p>\n\n\n\n<p>If there has been a <strong>mass conversion<\/strong> then the punishment with imprisonment shall not be <strong>less than Three years,<\/strong> extendable to <strong>Ten Years.<\/strong> Here the fine shall not be less than <strong>Rs. 50,000\/-.<\/strong><\/p>\n\n\n\n<p>If a person has been convicted has also <strong>been convicted in past under the same law<\/strong> then he\/she shall be liable for the twice of the punishment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Burden_of_Proof\"><\/span>Burden of Proof<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The person who is charged under this Law will be having the burden to prove that, he\/she didn&#8217;t contravene the provision of Law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Who_can_lodge_FIR\"><\/span>Who can lodge FIR?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"has-text-align-justify\">Any aggrieved person, his\/her parents, brother, sister, or any other person who is related to him\/her by blood, marriage or adoption may lodge a FIR for such conversion under this Law.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ordinance is called the Prohibition of Unlawful Conversion of Religion Ordinance, 2020.
