Allahabad High Court\nwhile hearing a writ petition held that, Employee\u2019s Compensation Act\n(hereinafter referred as ECA, 1923) which is an Act concerning to the Social\nSecurity gave following pronouncement.<\/p>\n\n\n\n

Held\n: \u00a0<\/strong><\/p>\n\n\n\n

  1. ECA,\n1923 is a welfare legislation for the purposes of providing social security to employees.<\/li>
  2. The\nobject of the Act is to protect the workmen from the\nhardship arising from accidents occurring during the course of employment.<\/li>
  3. While construing the provisions of welfare legislation, courts\nshould adopt, what is described as a beneficent rule of construction. If two\nconstructions are reasonably possible to be placed on the section, it follows\nthat the construction which furthers the policy and object of the Act and is\nmore beneficial to the employees, has to be preferred.<\/li><\/ol>\n\n\n[wpdm_package id=’1271′]\n\n\n\n
