SRI MANAGIPET @ MANGIPET SARVESHWAR REDDY<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Facts_of_the_case\"><\/span><strong>Facts\nof the case<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<p>Through these Criminal appeals before the Apex court\nthe order date 24<sup>th<\/sup> December, 2018 passed by the High Court of\nJudicature Hyderabad is being challenged by the State and by the accused.<\/p>\n\n\n\n<p>The impugned order by the Hon\u2019ble High Court was\npassed as a result of petition of the Accused officer under Section 482 of CrPC\nfor quashing of the charge sheet filed on 9<sup>th<\/sup> October 2017. The\naccused officer was charged with possession of assets worth Rs.3,18,61,500\/-\nalleged to be disproportionate to his know sources of income. <\/p>\n\n\n\n<p>The High Court quashed the charge sheet, holding that\nthere was a lack of authorization to register the Crime under section 13(2) and\n13(1)(e) of the Prevention of Corruption act, 1988 and that the informant (i.e.\nthe Deputy Superintendant of Police in this case) cannot be the Investigating\nofficer. <strong>(Para 5)<\/strong><\/p>\n\n\n\n<p>The appealed against the above two finding of the\nHon\u2019ble High Court, whereas the Accused officer challenged the findings of the\nHigh Court not accepting the grounds pressed by him in seeking the quashing of\nthe charge sheet \u2013 that there is no preliminary inquiry before the registration\nof the Crime\u2019 that there is no sanction and that there is a delay in the\ncompletion of the investigation which has prejudiced the rights of the Accused\nofficers.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"What_was_held\"><\/span><strong>What\nwas held? <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h4>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issue_1_Whether_the_Joint_Director_Anti-Corruption_Bureau_was_discharging_his_duties_as_a_Government_servant_or_as_a_Contractual_employee\"><\/span><strong>Issue\n1.\u00a0 Whether the Joint Director, Anti-Corruption\nBureau was discharging his duties as a Government servant or as a Contractual\nemployee?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The Apex court found a glaring irregularity in the\nfindings of the Hon\u2019ble High Court. The High Court held that the Joint\nDirector, Anti-Corruption Bureau K Sampath Kumar was re-employed and his age of\nSuperannuation was extended without the Compliance of Article 16. Article 16\nensures equality of opportunity for all citizens in the matters relating to employment\nto any office under the State. This would require the State to issue public\nadvertisement for filling of the office till an appropriate candidate is\nappointed by the UPSC or the candidate should be put before the body authorised\nunder the relevant rules for his selection. Which was not proved to be complied\nbefore the High Court and hence it held that the appointment of the Joint\nDirector was purely contractual and hence he cannot be called a government\nservant. The Apex Court Stating Article 310 which states that all members of\nthe defence services or of the civil services and other posts connected to\ndefence or civil services under the Union holds office at the pleasure of the\nPresident and under any State holds that office at the pleasure of the Governor.\nIt held that K Sampath Kumar was re-employed by the State Government in\nexercise of the powers conferred under Article 162 of the Constitution of\nIndia. It also held that there is no prohibition in any of the service rules\nthat there cannot be any re-employment of a person who was once in a civil\nservice. After being re-employed he was holding a civil post as his salary was\nbeing paid from the state exchequer and was discharging duties in\nresponsibility in the Anti-corruption Bureau. <\/p>\n\n\n\n<p>Thus the Supreme Court held that Sri K Sampath Kumar\nwas discharging his duties as Joint Director in the Anti-Corruption Bureau in\nexercise of powers conferred by the State Government and thus was in fact a\nGovernment Servant. <\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issue_2_Whether_Joint_Director_Anti-Corruption_Bureau_was_within_his_powers_to_authorise_the_registration_of_the_case_against_the_accuse_officer\"><\/span><strong>Issue\n2.\u00a0 Whether Joint Director\nAnti-Corruption Bureau was within his powers to authorise the registration of\nthe case against the accuse officer?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>\u00a0The Court held\nthat K. Sampath whilst discharging his duties as Joint Director,\nAnti-corruption Bureau had full authority of the office he held. It held that\nif the action taken by such officer is in public interest and not for his own\nbenefit then it will be taken to be valid. <\/p>\n\n\n\n<p>The court based its findings on the de facto doctrine.\nThe doctrine basically says that a Judge is not a mere intruder or a usurper but\nis one who holds the office under the colour of lawful authority. Which\nessentially make the office the essence of the matter? Even though the\nappointment of an officer may carry some defects, the actions taken by him are\nin the name and power of the office and thus would carry the same power as if\nthere are no defects, unless such actions are unlawful.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issue_3_Whether_an_informant_can_be_an_investigating_officer_in_the_same_case\"><\/span><strong>Issue\n3.\u00a0 Whether an informant can be an\ninvestigating officer in the same case?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>\u00a0The Court found\nthat the Judgement in the case Mohan lal v State of Punjab on which the High\nCourt based its order on was held to be prospective in the Judgement in the\ncase of Varinder Kumar vs State of Himachal, the court in this case held that\nthere should be a balance in the rights of the accused and the prosecution and\nthe Criminal Justice system cannot be allowed to veer exclusively on the side\nof the accused.<\/p>\n\n\n\n<h5 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"Issue_4_Whether_preliminary_inquiry_before_registration_of_a_crime_is_mandatory\"><\/span><strong>Issue\n4. Whether preliminary inquiry before registration of a crime is mandatory? <\/strong><span class=\"ez-toc-section-end\"><\/span><\/h5>\n\n\n\n<p>The counsel appearing for the accused heavily relied\non the judgement reported as <strong>Lalita\nKumari v Government of Uttar Pradesh &#038; Ors<\/strong>. in which case it was laid\ndown that preliminary inquiry is warranted so as to avoid an abuse of the\nprocess of law. Where the police officer is doubtful of the veracity of an\naccusation, he has to conduct a preliminary inquiry. To which the court replied\nthat if the information given by informant discloses a cognizable offence\nregistration of an FIR is mandatory and no preliminary inquiry is permissible\nin such a situation.<\/p>\n\n\n\n<p>Preliminary inquiry is not a must in all cases and <strong>may<\/strong> <strong>be<\/strong> conducted pertaining to Matrimonial disputes\/family disputes,\nCommercial offences, Medical negligence cases and Corruption cases etc. The\nJudgement of the Apex Court in Lalita Kumari\u00a0\ncase does not state that proceedings cannot be initiated against the\naccused without conducting a preliminary inquiry.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Aashray Chaudhary | Symbiosis Law School, Hyderabad | 10th December 2019 THE STATE OF TELANGANA v.
