{"id":8173,"date":"2021-01-22T07:24:18","date_gmt":"2021-01-22T07:24:18","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=8173"},"modified":"2021-01-22T07:24:42","modified_gmt":"2021-01-22T07:24:42","slug":"palghar-bail-incident","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/palghar-bail-incident\/","title":{"rendered":"All 89 accused in &#8220;Palghar Lynching case&#8221; got bail [Read Order]"},"content":{"rendered":"\n<p>Thane Session Court granted bail to several accused of Palghar lynching case.<\/p>\n\n\n\n<p>Court cited that, <\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>Bail is rule and Jail is an exception<\/p><cite>Thane Sessions Court<\/cite><\/blockquote>\n\n\n\n<p>Court observed that accused should not be detained as pretrial conviction.<\/p>\n\n\n\n<p><strong>Judge : SB Bahalkar<\/strong><\/p>\n\n\n\n<p>Court opined that, keeping accused in Jail won&#8217;t be serving any purpose. It won&#8217;t help in investigation. Court finally considered the bail terms and granted them the bail.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote\"><p>No purpose of the prosecution would be solved by keeping the accused behind bars.<\/p><\/blockquote>\n\n\n\n<p>On 16th April, mob lynched three persons, in which two were 70 year old Sadhus.<\/p>\n\n\n\n<p>Charges were put against the mob under Distraction of Public Property Act, Maharashtra Police Act, Disaster Management Act and Epidemic Disease Act.<\/p>\n\n\n\n<p>Special Public Prosecutor alleged that the accused were part of the unlawful assembly.<\/p>\n\n\n\n<p>However, the opposition, suggested otherwise.
