{"id":8215,"date":"2021-01-25T14:31:15","date_gmt":"2021-01-25T14:31:15","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=8215"},"modified":"2021-01-25T14:31:31","modified_gmt":"2021-01-25T14:31:31","slug":"ncpcr-letter-posco-bombay","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/ncpcr-letter-posco-bombay\/","title":{"rendered":"NCPCR wants an urgent appeal against Bombay HC&#8217;s &#8216;only skin-to-skin amounting sexual assault&#8217; verdict"},"content":{"rendered":"\n<p>The National Commission for Protection of Child Rights (NCPCR); wants an urgent appeal against the <strong><em><a href=\"https:\/\/lexforti.com\/legal-news\/groping-and-pressing-breast-without-removing-the-clothes-of-a-12-year-old-child-not-sexual-assault-bombay-hc\/\" target=\"_blank\" rel=\"noreferrer noopener\">recent verdict of the Bombay High Court.<\/a> <\/em><\/strong><\/p>\n\n\n\n<p>Recently Bombay High Court in a case held that; even though the perpetrator was touching the breast of a 12-year-old child; it will not amount to &#8216;Sexual Assault&#8217; under the <a href=\"https:\/\/wcd.nic.in\/sites\/default\/files\/POCSO-ModelGuidelines.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">POCSO Act<\/a>, as there was no skin-to-skin contact.<\/p>\n\n\n\n<p>Bombay High Court termed such offence under the category of &#8216;outraging the modesty of woman&#8217; under Section 354 of IPC.<\/p>\n\n\n\n<p>The perpetrator was a 39-year-old guilty while the victim was merely 12-year-old.<\/p>\n\n\n\n<p>NCPCR on Monday wrote a letter to the Maharashtra Chief Secretary.
