{"id":9183,"date":"2021-04-15T12:05:41","date_gmt":"2021-04-15T12:05:41","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=9183"},"modified":"2021-04-15T12:06:01","modified_gmt":"2021-04-15T12:06:01","slug":"sc-reserves-order-on-plea-filed-for-appointment-of-ad-hoc-judges-in-hc","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/sc-reserves-order-on-plea-filed-for-appointment-of-ad-hoc-judges-in-hc\/","title":{"rendered":"SC reserves order on plea filed for appointment of ad-hoc judges in HC"},"content":{"rendered":"\n<p>The Apex Court has reserved orders on a plea which sought for appointment of ad-hoc judges in High Courts by making a reference to Article 224A of Indian Constitution.<\/p>\n\n\n\n<p>The bench headed by Chief Justice of India was hearing a plea filed by an NGO, Lok Prahari, which sought for invocation of Article 224A in order to handle the issue of pending cases at the High Courts.<\/p>\n\n\n\n<p>The bench stated that the instant case would not be completely disposed off and interim orders would be passed in the nature of continuing mandamus.<\/p>\n\n\n\n<p>The bench observed that Article 224A appears as a salutary provision. It <a href=\"https:\/\/lexforti.com\/legal-news\/even-if-not-received-an-appointment-letter-but-worked-in-organisation-then-also-you-are-entitled-for-retirement-benefits\/\" target=\"_blank\" rel=\"noreferrer noopener\">also stated that if ad-hoc judges are appointed<\/a> for the purpose of clearing the arrears, the courts would be able to devote more time for deciding the <a href=\"https:\/\/lexforti.com\/legal-news\/pil-filed-before-delhi-hc-for-constitution-of-regulatory-body-for-non-film-songs-and-music-videos\/\" target=\"_blank\" rel=\"noreferrer noopener\">constitutional<\/a> matters pending before it.<\/p>\n\n\n\n<p>The bench also made a suggestion that the ad-hoc judges could take care of the old cases which have been pending for over 10-15 years and the regular judges could hear the current matters as and when filed.<\/p>\n\n\n\n<p>On the previous hearing for this matter, the apex court had asked the senior advocates, which represented different High Courts, to make joint suggestions regarding the appointment of ad-hoc judges.<\/p>\n\n\n\n<p>One of the senior advocate, representing the Orissa HC, stated that a written note had been submitted to the <a href=\"https:\/\/lexforti.com\/legal-news\/courts-have-the-power-to-allow-such-relief-having-regard-to-the-that-of-upsc-if-the-interpretation-so-adopted-is-narrow-and-over-restrictive-although-the-error-committed-by-the-petitioner-is-clearly\/\" target=\"_blank\" rel=\"noreferrer noopener\">court which contained suggestions regarding<\/a> the appointment procedure, allowances, tenure, etc. of the ad-hoc judges.<\/p>\n\n\n\n<p>The President of SCBA also gave a suggestion and <a href=\"https:\/\/lexforti.com\/legal-news\/state-must-pay-compensation-for-the-torts-committed-by-its-employees\/\" target=\"_blank\" rel=\"noreferrer noopener\">stated that the ad-hoc judges must<\/a> be allowed to handle the arbitration work, however, the same was not considered by the bench.<\/p>\n\n\n\n<p>The bench also stated that the allowances of ad-hoc judges would be drawn from the Consolidated Fund of India.<\/p>\n\n\n\n<p>Moreover, the bench opined that the fitness of the person would be relevant factor while deciding continued appointment of judges.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Apex Court has reserved orders on a plea which sought for appointment of ad-hoc judges in High Courts by making a reference to Article 224A of Indian Constitution.
