The Supreme Court judge, Justice Indira Banerjee, recused from hearing a petition which sought for CBI or SIT probe into the killings of two BJP workers which took place during post-poll violence<\/a> in West Bengal.<\/p>\n\n\n\n

The division bench of Justices MR Shah and Indira Banerjee were hearing a writ petition filed by one of the deceased\u2019s brother, when Justice Indira Banerjee, who happens to hail from West Bengal, stated her difficulty to deal with the matter.<\/p>\n\n\n\n

Subsequently, the matter was adjourned and the registry was directed to list the matter before a bench where Justice Indira Banerjee would not be a part of.<\/p>\n\n\n\n

In the instant, the petitioner alleged that the killings were conducted by the members of Trinamool Congress during the infamous post-poll violence which took place after the declaration of results. The plea also sought for directions for an investigation into the acts of widespread violence where allegations of sexual assault<\/a> and theft were also raised.<\/p>\n\n\n\n

As of now, the vacation bench had directed the West Bengal government to file <\/a>a counter-affidavit upon its learning that FIR\u2019s had been registered by the state police in respect of both the killings. Subsequent to that, the state police had arrested three persons each based upon the allegations in the complaint.<\/p>\n\n\n\n

Moreover, upon the request of petitioners, the bench had impleaded NHRC, National Commission for Women, National Commission for SC\/ST, and National Commission for the Protection of Child Rights as additional respondents. <\/p>\n\n\n\n

Currently, the matter has been adjourned and Solicitor General\u2019s request of listing the matter in the coming week had been denied as the presiding judge had recused from the matter.<\/p>\n","protected":false},"excerpt":{"rendered":"
