Balsara <\/strong>where the validity of Sections 12 and 13 (dealing with prohibition on manufacture, <a href=\"https:\/\/lexforti.com\/legal-news\/writ-petition-seeking-writ-of-mandamus-or-any-other-writ-to-allow-sale-of-liquor\/\" target=\"_blank\" rel=\"noreferrer noopener\">sale and consumption of liquor<\/a>) had been upheld.<\/p>\n\n\n\n<p>The counsel appearing for petitioners contended that earlier, the challenge to the legislation was limited to the extent of usage in medicinal and toilet preparation. The question of validity of prohibiting consumption of liquor had not been addressed by the apex <a href=\"https:\/\/lexforti.com\/legal-news\/the-court-during-judicial-review-do-not-have-the-same-power-as-that-of-an-appellate-authority\/\" target=\"_blank\" rel=\"noreferrer noopener\">court thus making Gujarat HC a competent authority<\/a> to adjudicate the issue at hand.<\/p>\n\n\n\n<p>The counsel argued that the restrictions imposed by legislation on the right of citizens\u2019 to possess, sell and consume alcohol had not been disputed before the apex court in view of DPSPs.<\/p>\n\n\n\n<p>Moreover, the counsel highlighted that the new Right to <a href=\"https:\/\/lexforti.com\/legal-news\/right-to-access-to-internet-is-an-integral-part-of-right-to-education-privacy-under-article-21-is-subjected-to-restrictions-on-free-speech-under-article-192-of-the-indian-constitution\/\" target=\"_blank\" rel=\"noreferrer noopener\">Privacy had been included under the umbrella of Article 21<\/a> in the year 2017. So the Supreme Court had no opportunity to address the issue back in 1951.<\/p>\n\n\n\n<p>The counsel also remarked that Right to Privacy has links with the citizens\u2019 right to choice w.r.t. what they eat and drink.
