{"id":9924,"date":"2021-06-30T12:06:46","date_gmt":"2021-06-30T12:06:46","guid":{"rendered":"https:\/\/lexforti.com\/legal-news\/?p=9924"},"modified":"2021-06-30T12:07:06","modified_gmt":"2021-06-30T12:07:06","slug":"ndma-to-frame-guidelines-for-ex-gratia-compensation-to-covid-victims","status":"publish","type":"post","link":"https:\/\/lexforti.com\/legal-news\/ndma-to-frame-guidelines-for-ex-gratia-compensation-to-covid-victims\/","title":{"rendered":"NDMA to frame guidelines for ex-gratia compensation to COVID victims"},"content":{"rendered":"\n<p>The Apex Court directed the National Disaster Management Authority (NDMA) to frame guidelines for recommending minimum ex-gratia assistance to the COVID-19 victims.<\/p>\n\n\n\n<p>The bench held that its NDMA\u2019s statutory obligation, under Section 12 of the Disaster Management Act, to recommend minimum relief for the victims of a national disaster, like the pandemic. The bench, however, clarified that the minimum relief would be inclusive of \u201cex-gratia assistance.\u201d<\/p>\n\n\n\n<p>In the instant case, the petitioners <a href=\"https:\/\/lexforti.com\/legal-news\/sebi-circulars\/\" target=\"_blank\" rel=\"noreferrer noopener\">filed writ petitions<\/a> and sought directions for Centre and the States to provide ex-gratia compensation of Rs. 4 lakh to the family members of those who\u2019ve succumbed to the pandemic and the ones suffering post-COVID complications.<\/p>\n\n\n\n<p>The petitioners also sought for a relief w.r.t. to the simplification of process of issuing death certificates of those who have lost lives during the pandemic. The bench delivered its judgment in affirmation in the cases of <strong>Gaurav Kumar Bansal v UOI<\/strong> and <strong>Reepak Kansal v UOI &amp; Ors<\/strong>.<\/p>\n\n\n\n<p>The Union government argued that Section 12 was not a mandatory provision as it interpreted the word \u201cshall\u201d as \u201cmay.\u201d The bench rejected Union\u2019s contention and noted that usage of \u201cshall\u201d denotes a provision to be mandatory.<\/p>\n\n\n\n<p>The Union also putforth that though unfortunate, but true that government has limited resources and additional burden through ex-gratia might reduce the <a href=\"https:\/\/lexforti.com\/legal-news\/bar-council-of-india-can-enquire-into-the-matters-of-the-keralas-state-bar-council-and-trustee-committee-of-the-advocates-welfare-fund\/\" target=\"_blank\" rel=\"noreferrer noopener\">funds available for other health as well as welfare<\/a> schemes.<\/p>\n\n\n\n<p>In the judgment, the bench <a href=\"https:\/\/lexforti.com\/legal-news\/courts-failing-to-use-the-power-for-advancement-of-justice-can-also-lead-to-grave-injustice\/\" target=\"_blank\" rel=\"noreferrer noopener\">also held that NDMA failed<\/a> to discharge its duty to by not recommending ex-gratia assistance. The bench stated that the NDMA failed to discharge its functions under Section 12 which was to provide for minimum standards of relief for the victims.<\/p>\n\n\n\n<p>However, the bench <a href=\"https:\/\/lexforti.com\/legal-news\/gatherings-prescribed-size-small-large\/\" target=\"_blank\" rel=\"noreferrer noopener\">stated that it cannot direct Central Government<\/a> to pay a specific amount as compensation and thus, directed NDMA to frame guidelines regarding ex-gratia assistance within six weeks.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Apex Court directed the National Disaster Management Authority (NDMA) to frame guidelines for recommending minimum ex-gratia assistance to the COVID-19 victims.
