M/S Vasu Infrustructure Private Ltd. v. State of U.P. & Ors., WRIT – C No. – 26540 of 2019
Allahabad High Court while hearing a writ petition held that, Employee’s Compensation Act (hereinafter referred as ECA, 1923) which is an Act concerning to the Social Security gave following pronouncement.
Held :
- ECA, 1923 is a welfare legislation for the purposes of providing social security to employees.
- The object of the Act is to protect the workmen from the hardship arising from accidents occurring during the course of employment.
- While construing the provisions of welfare legislation, courts should adopt, what is described as a beneficent rule of construction. If two constructions are reasonably possible to be placed on the section, it follows that the construction which furthers the policy and object of the Act and is more beneficial to the employees, has to be preferred.
