Judicial Service- A Candidate applied under General Category; later on, cannot claim a reserved seat of Disabled Category.

Case Brief-

Respondent in the current case is suffering from 80% of visual impairment, she accidentally while filling form selected ‘general’ instead of ‘PWD Category’. For the same post respondent had filled the form in the year 2013 under ‘PWD Category’, for which appellant allowed her to appear the exam. She contended that considering her disability and the object of Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995; she should be allowed to claim the reservation of seat under PWD category.

Held-

It was held that when a candidate applies for a seat under general category; later on, such candidate can’t claim for the seat under the disabled category.
