Mushrooming of law colleges is not an issue as long as quality of education is not compromised- Madras HC

The Madras High Court, while hearing a plea that sought for the drafting of rules in order to reduce the number of upcoming private law colleges, observed that in disguise of creation of new opportunities, quality of courses should not be compromised.

The bench also observed that the standard of education being imparted at few law colleges and their infrastructure must be looked into in order to cross-check the opportunities promised.

The State Bar Council, which appeared before the court, submitted that vigilant and effective measures have been taken care of by the respective institutions. The Bar, however, stated that unless there is a presence of uniformity throughout the country, this issue could not be addressed appropriately.

The bench agreed to the above submission of the Bar and stated that substance of law would be undone if what is not allowed in one state, is allowed by the other state. If other state allows free access to such unregulated private institutions, then all the efforts would go in vain.

The bench also opined that a pan-India level order has to be passed in this regard and to see that newly born law colleges do not create fake opportunities and misuse the trust of students who wish to pursue law.

The bench, however, denied providing any remedy under the writ of mandamus in nature which the petitioner had sought for.

The bench clarified that an order within the state boundaries of Madras would not serve the purpose as it would not be applicable on other States.

The bench gave full liberty to the petitioner to appear before the Bar Council of India and make a representation with regard to the issue within four weeks.
