The National Commission for Protection of Child Rights (NCPCR); wants an urgent appeal against the recent verdict of the Bombay High Court.
Recently Bombay High Court in a case held that; even though the perpetrator was touching the breast of a 12-year-old child; it will not amount to ‘Sexual Assault’ under the POCSO Act, as there was no skin-to-skin contact.
Bombay High Court termed such offence under the category of ‘outraging the modesty of woman’ under Section 354 of IPC.
The perpetrator was a 39-year-old guilty while the victim was merely 12-year-old.
NCPCR on Monday wrote a letter to the Maharashtra Chief Secretary. The letter stated that the Judgement needs to be reviewed.
