Plea before SC regarding release of Rohingya refugees detained in Jammu

The Apex Court has been approached, through an interim application in a pending writ petition, in order to seek directions for the immediate release of Rohingya refugees which have been detained in Jammu.

The pending writ petition had been filed in order to seek protection of the Rohingya refugees who were facing the imminent threat of being deported.

The instant application has also sought directions to refrain ruling government from deporting the said refugees and has also sought for UNHCR’s intervention to assess the needs of refugees and grant refugee identification cards to them.

The refraining orders have been sought not only for the camps set up in Jammu but also for the ones set up across the country.

The instant application had been filed in furtherance of the news reports which stated that around 170 Rohingya refugees had been detained in Jammu. Moreover, the Union Minister’s statement that Rohingya (Muslim refugees) wouldn’t be able to secure citizenship in the country.

In wake of the news that certain refugees though have been identified have not reached the camps and have been missing, this application has been filed in order to protect the rights of such refugees.

Moreover, various families of these refugees have been separated even though their biometric verification has been undertaken.

The applicant stated that since India has not passed any legislation w.r.t. the rights of refugees, Rohingya’s have been clubbed with the class of illegal migrants and they might be deported under the Foreigners Act, 1946 and Foreigners Orders, 1948.

This application is in furtherance to the pending writ petition filed before the Supreme Court and has sought directions to respective authorities in order to comply with humanitarian values.
