The Apex Court, while hearing pleas against cancellation of CBSE/ICSE 12th board exams, stated that it would not interfere with the decision taken by CBSE and ICSE of cancelling physical examination of class 12th.
The bench dismissed the petitions on the ground that decision taken by respective authorities was well-informed and was taken with an intention to protect the welfare of over 20 lakh students.
The bench observed that CBSE/ICSE are independent boards and they’re not bound by other boards and institutions which had been able to conduct exams. The bench supported the decision of CBSE/ICSE and stated that it had been taken for the larger interest of students.
Apart from this, the bench also upheld the alternative assessment scheme formulated by CBSE and ICSE, and considered the decision of experts in that field without any doubt. The bench further observed that the alternative scheme does not stand in prejudice to any candidate.
The opposition counsel contended that when other entrance tests like NDA, IIT etc. were being conducted, the CBSE/ICSE had no reason to not conduct class 12th exams. The bench rejected the contention and stated that the number of students appearing for entrance tests and those for class 12th exams differ. The bench also enquired whether the opposition would take the responsibility if students get exposed to COVID-19.
The bench concluded the hearing by observing that there has to be a finality to the status of exams as uncertainty would affect the psychology of students.
